City Council Meeting Minutes August 16, 2016 <br /> The Council reconvened into Open Session at 5:46 p.m. The Council provided <br /> direction to Staff in Executive Session and those items will be brought back at a <br /> future date. <br /> PRESENTATIONS <br /> 3. Receive a Staff update on the Cape's Dam removal permitting process, and <br /> associated projects, and discuss and provide direction regarding the future of the <br /> Cape's Dam Mill Race. <br /> Jared Miller, City Manager, provided an overview of the presentation the <br /> Council will be provided and introduced Mike Montain with U.S. Fish and <br /> Wildlife. Mr. Montain provided the Council with a presentation providing an <br /> update on the Cape's Dam removal permitting process, other associated <br /> projects and a possible timeline for the removal of the dam. Council held <br /> discussion regarding permitting of a weir, regarding the repair of the dam by <br /> encasing the dam in concrete, regarding the mill race and it's preservation, <br /> regarding consultation with the ARmy Corps of Engineers relative to options <br /> for permitting to retain water in the mill race. Before the dam is removed the <br /> Council provided direction for Staff to work with Dr. Hardy and/or other <br /> subject matter experts to explore and assess an engineered solution to retain <br /> water in the mill race, the seperate permitting process that would be required, <br /> and an estimate of the cost for the potential solution. It was also suggested that <br /> a meeting be hosted between the pro-removal and anti-removal groups along <br /> with Dr. Hardy and see if a compromise can be reached. <br /> 4. Receive an overview and discuss the San Marcos Ethics Review Commission's <br /> recommendations regarding amendments to the San Marcos Code of Ethics (Chapter <br /> 2, Article 5 of the San Marcos City Code), and provide direction to staff <br /> Bill DeSoto, Ethics Review Commission Chair, provided the Council with the <br /> board's recommendations. They included: amending the definition of <br /> 'employee', amending the definition of'officer or official', amending Sec. 2.423 <br /> (a) (G) adding "any benefit or..." striking "twelve" and inserting "twenty <br /> four" months, amending Sec. 2.423 (c) (1) entirely, amending Sec. 2.426 (a) <br /> striking "one year" and inserting "two years", amending Sec. 2.426 (b) <br /> striking "one year" and inserting "two years", amending Sec. 2.426 (c) <br /> striking "one year" and inserting "two years" and inserting "or to a former <br /> employee whose skills or experience are <br /> so unique that failure to contract with him or her would be a detriment to the <br /> city as determined <br /> by the city manager," amending Sec. 2.446 adding "Criminal Penalty" and <br /> adding (a) "A person who violates any provision of this article shall be <br /> punished, upon 11 conviction thereof, by a fine not to exceed $500.00." and (b) <br /> City of San Marcos Page 2 <br />
