INTERLOCAL COOPERATION AGREEMENT <br /> BETWEEN TEXAS STATE UNIVERSITY AND <br /> THE CITY OF SAN MARCOS <br /> FOR THE PROVISION OF WATER QUALITY ANALYTICAL TESTING SERVICES <br /> Contract No.: 216-378 <br /> STATE OF TEXAS <br /> COUNTY OF HAYS <br /> The City of San Marcos ("City") and Texas State University (the "University") <br /> collectively referred to as the "Parties" enter into this Interlocal Agreement (the "Agreement") <br /> under the authority of the Interlocal Cooperation Act (the "Act"), Chapter 791 of the Texas <br /> Government Code, as amended. <br /> RECITALS: <br /> WHEREAS, the City wishes to procure water quality analytical testing services from <br /> University; and <br /> WHEREAS, it is in the interest of economy and efficiency, that the parties enter into a <br /> cooperative program; and <br /> NOW THEREFORE, in consideration of the mutual covenants and promises contained <br /> herein, the parties agree as follows: <br /> Section 1. Scope of Services <br /> University agrees to provide microbiological, liquid and solid analytical services (the <br /> "Services") in accordance with applicable State and Federal laws, rules, regulations and orders as <br /> applicable and the cost proposal attached to this Agreement as Attachment A. <br /> Section 2. City Responsibilities <br /> The City agrees to provide accurate information and render decisions as expeditiously as <br /> possible for the orderly progress of University's services. <br /> Section 3. Compensation <br /> The City agrees to pay the University a not to exceed total fee of <br /> 1 <br />
