ORDINANCE NO. 2016-49 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING THE INSTALLATION OF A TRAFFIC DIVERTER ON EBONY STREET AT THE IH -35 ACCESS ROAD; AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. Ebony Street is a neighborhood street providing access to the IH -35 access road and residents have complained that large volumes of freeway traffic use Ebony Street to cut through the neighborhood during peak hours. 2. Such traffic conditions are not safe for residents and residents have submitted a petition for the installation of a permanent traffic diverter at Ebony at the IH 35 access road. 3. City staff has conducted a study regarding such conditions and determined that a traffic diverter would alleviate traffic on Ebony Street. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Recitals are hereby found to be true and correct and are adopted as the findings of the City Council. SECTION 2. On the basis of such findings, the City Council hereby authorizes the installation of a traffic diverter on Ebony Street at the IH -35 Access Road. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. This ordinance shall be effective upon its adoption on second reading. PASSED AND APPROVED on first reading on November 1, 2016. PASSED, APPROVED AND ADOPTED on second reading on November 15, 2016.
