by the floodplain administrator; provided however, written notice shall follow within five <br />working days from the time oral notice to stop is issued. <br />Sec. 39.036. Penalties for violation. <br />Violations of the provisions of this article or failure to comply with any of its <br />requirements shall constitute a misdemeanor. Each violation shall be deemed a separate <br />offense for each and every day during which any violation of any of the provisions of this <br />article is committed or continued. Any person found guilty of violating a provision of this <br />article may be punished as provided for in section 1.015 of this Code. <br />Secs. 39.037-39.040. Reserved. <br />DIVISION 3. STANDARDS FOR FLOOD HAZARD REDUCTION <br />Sec. 39.041. General standards. <br />In all areas of special flood hazards, determined by FEMA or by the community in <br />areas where FEMA has not determined the areas of special flood hazard, the following <br />provisions apply: <br />(1) The floodplain administrator shall review permits for proposed construction or <br />other development, including the placement of manufactured homes, so that a <br />determination may be made whether or not such construction or other <br />development is proposed within flood -prone areas. <br />(2) The developer of new construction, substantial improvements, and other <br />development proposals must assure that all necessary permits have been obtained <br />from those governmental agencies from which approval is required by federal or <br />state law, including Section 404 of the Federal Water Pollution Control Act, as <br />amended, or by other regulating agencies. <br />(3) All new construction and substantial improvements must be designed (or <br />modified) and adequately anchored to prevent flotation, collapse, or lateral <br />movement of the structure resulting from hydrodynamic and hydrostatic loads, <br />including the effects of buoyancy. <br />(4) All new construction and substantial improvements must be constructed with <br />materials and utility elements resistant to flood damage. <br />(5) All new construction or substantial improvements must be constructed by <br />methods and practices that minimize flood damage. <br />(6) Electrical, heating, ventilation, plumbing, air conditioning equipment and other <br />service facilities, including duct work, must be designed and /or located so as to <br />
