RESOLUTION 2009-95R <br />AN AMENDED RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, RATIFYING THE SUBMISSION <br />OF A NEIGHBORHOOD STABILIZATION GRANT TO THE TEXAS <br />DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS, <br />ACKNOWLEDGING NSP AS A REIMBURSEMENT PROGRAM; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE GRANT <br />AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. On April 27, 2009, a Neighborhood Stabilization Program (NSP) grant <br />application was submitted to Texas Department of Housing and Community <br />Affairs (TDHCA) requesting reimbursement for certain specified projects in <br />the amount of $525,000. By notice dated June 17, 2009, TDHCA requested <br />that corrections be made to the City's application and that the governing <br />body adopt an amended Resolution. <br />2. The proposed grant request, as amended, seeks reimbursement funding <br />for two Programs: HOUSING: (a) $420,000 for the acquisition and resale of <br />three (3) foreclosed single-family residences to households with a total <br />• annual income that does not exceed 50% of area median income; (b) <br />$29,850 for minor rehabilitation and energy efficiency upgrades to the <br />residences; (c) $150 for homebuyer education and DEMOLITION: $50,000 <br />for removal of 8 vacant unsafe structures. <br />3. The request includes a request for reimbursement for up to $25,000 in <br />Program Administration costs. <br />4. If the City is awarded this grant, matching funds will not be required. <br />5. In the Notice of Funding Availability published by TDHCA, under Section <br />12(g), all applicants must submit an original resolution from the direct <br />governing body that authorizes the following: (a) the submission of the <br />application by the applicant; (b) acknowledgement of NSP as a <br />reimbursement program; and, (c) the designation of a person and the <br />person's title authorized to represent the organization and having signature <br />authority to execute a contract. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />PART 1. The submission of an NSP grant application to Texas Department <br />• of Housing and Community Affairs is ratified and the City of San Marcos <br />acknowledges that the Texas NSP grant is a reimbursement program.
