55 <br /> <br />Regular Meeting January 27, 1997 Page 6 <br />Mr. Hernandez introduced the City Council's Report. (1) Mr. Cox <br />brought forward a discussion regarding Robby Robbins' issue during <br />the citizen comment period. Mayor Moore stated he is aware of the <br />matter and has discussed it with Mr. Gilley and Mr. Robbins and is <br />trying to reach the Mayor of Kyle to get a meeting with Kyle to <br />assist. Kyle wants to provide water at retail. Mr. Robbins stated <br />he has had no reaction from Kyle and is asking the Council to help <br />him. Mayor Moore stated he hopes to be in touch with the Mayor of <br />Kyle. Mr. Guerra requested information be provided to the Council <br />regarding the agreement San Marcos has with Kyle. (2) Ms. Hughson <br />stated she wants there to be a policy regarding carnivals, and Mr. <br />Gilley stated carnivals are allowed in conjunction with an event. <br />The Council directed there to be a written park policy for <br />consistency with carnivals being one issue. (3) Ms. Hughson asked <br />if SWT would be present at the Joint Workshop, and Mr. Gilley <br />advised Dr. Supple or his representative has been invited. <br />Mr. Hernandez introduced an Executive Session pursuant to the <br />Government Code, Section 551.071, to discuss matters where the City <br />Attorney's ethical duty to the City clearly conflicts with <br />Government Code Chapter 551 (Aquarena Springs taxation; GBRA Surface <br />Water Project Contract; economic development incentive proposal); <br />Sections 551.072 and 551.073, to discuss the purchase of real <br />property (Surface Water Treatment Plant); and Section 551.074, to <br />discuss the duties of a public employee (City Manager). Mr. <br />Hernandez moved to adjourn into Executive Session at 10:39 p.m. and <br />Mr. Mihalkanin seconded the motion, which passed unanimously. <br />Mr. Guerra moved to reconvene at 12:04 a.m. and Mr. Mihalkanin <br />seconded the motion, which passed unanimously. <br />The meeting adjourned at 12:16 a.m. on motion made by Mr. Hernandez <br />and seconded by Mr. Mihalkanin. <br />Billy "a.
