• RESOLUTION NO. 2009- 96R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS SUPPORTING THE DESIGNATION <br />OF A SEGMENT OF THE SAN MARCOS RIVER EXTENDING <br />FROM IH 35 TO ITS HEADWATERS AS A STREAM <br />SEGMENT HAVING UNIQUE ECOLOGICAL VALUE UNDER <br />SECTION 16.05 l (f) OF THE TEXAS WATER CODE; AND <br />DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The South Central Texas Regional Water Planning Group (Region L) has <br />conditionally recommended to the Texas Legislature that a segment of the San Marcos River <br />extending from IH 35 upstream to its headwaters be designated as a stream segment having <br />ecologically unique value. <br />2. The only constraint that may result from this designation is that a state agency or a <br />political subdivision of the state may not finance the actual construction of a water supply <br />reservoir on this unique stream segment. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />• TEXAS: <br />PART 1. The City of San Marcos supports the conditional recommendation of the South <br />Central Regional Water Planning Group (Region L) that the Texas Legislature designate a <br />segment of the San Marcos River extending from I1-135 to its headwaters as a unique stream <br />segment. <br />PART 2.
