• ORDINANCE 2009 - 40 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS AMENDING THE TRAFFIC <br />REGISTER MAINTAINED UNDER SECTION 82.067 OF THE <br />SAN MARCOS CITY CODE BY AMENDING THE SPEED <br />LIMITS ALONG A SECTION OF S.H. 123 IN BOTH <br />DIRECTIONS FROM A POINT SOUTH OF MONTEREY <br />OAKS TO THE SAN MARCOS SOUTH CITY LIMITS; <br />PROVIDING A SAVINGS CLAUSE; PROVIDING THAT ALL <br />CONFLICTING ORDINANCES ARE REPEALED; AND <br />PROVIDING AN EFFECTIVE DATE. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Pursuant to Sections 82.003 and 82.066 of the City Code, on the basis <br />of an engineering and traffic investigation performed by the Texas Department of <br />Transportation finding that the current state maximum speed limit is unreasonable, the <br />traffic register maintained under Section 82.067 of the City Code is amended by adding the <br />following speed limits in the locations described: <br />is a. S.H. 123, both directions, from A POINT 581 feet south of Monterey <br />Oaks to the South City limits, a prima facie speed of 60 miles per hour. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the <br />invalid portion. <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 4. This ordinance shall be in effect ten days from and after its passage. <br />PASSED AND APPROVED on first reading July 7, 2009 <br />PASSED, APPROVED AND ADOPTED July 21, 2009 <br />(?'
