<br />5 <br /> <br /> <br /> <br />Regular Meeting May 13, 1996- Page 5 <br />NAY: Hart, Guerra, Hernandez. <br /> <br />ABSTAIN: None. <br /> <br />I Mayor Moore introduced for consideration Item 9.B.(2) removed ITom the consensus agenda, <br />I approval of an Ordinance on second reading, the caption which was read as follows: <br />I <br /> <br />I At'f ORDINAt~CE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />- TEXAS, AMENDING ARTICLE 3 OF CHAPTER 86, UTILITIES, OF THE SAN <br />MA.RCOS CITY CODE BY ADDING DIVISION 3, ON-SITE SE\V AGE FACILITIES; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENAL TIES. <br /> <br />Mr. Guerra moved for approval of the Ordinance on second reading and Mr. Hart seconded the <br />motion. Ms. Hughson asked if people who live downhill did not have to connect to the <br />wastewater system because of the gravity flow. Mr, Gilley stated other options were available <br />such as lift stations, but because of the cost of the individua11ift stations, it was not required. He <br />stated in some situations property owners installed or the city assised in providing a lift station <br />where it was merited. Referring to Section 86.156, Ms. Hughson asked if all existing facilities <br />were inspected. Mr. Gilley stated inspections occurred only if problems appear. Ms. Hughson <br />asked if S 1 00 for written requests, exceptions or appeals was a high fee. j\1¡-. Ewald stated these <br />were special requests or exemptions that would take a lot of time and possible state review. <br />Mayor Moore asked if the definition of on-site sewage facility included also composting toilets <br />and other new technologies. Mr. Ewald stated that was correct, that alternative designs were <br />included. The Council then voted unanimously for approval of the Ordinance on second reading. <br />O\'fr. Hernandez not present on roll call). <br /> <br />Mayor Moore introduced for consideration Item 9.D.(I) removed from the consensus agenda, <br />adoption of a Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE PURCHASE OF 28 MICROCOJ\1PUTERS At'fD 10 <br />PRINTERS FOR THE POLICE DEPARTMENT AUTOMATION "CRTh1ES" SYSTEM <br />THROUGH THE STATE DEPARTNfENT OF INFORMATION RESOURCES; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE PURCHASING <br />DOCUNfENTS WITH THE STATE ON BEHALF OF THE CITY Ai'fD DECLARING <br />At'f EFFECTIVE DATE. <br /> <br />Mr. Guerra moved for adoption of the Resolution and Ms. Hughson seconded the motion. Ms. <br />Hughson asked if purchases through the development of Information Resources had been <br />successful in the past and Mr. Gilley stated that was correct. Mr. Cox asked if there are risks <br />associated with these purchases since there have been delays in the project. Mr. Gilley stated that <br />the risks are minimal since the City has already made a substantial investment in hardware for the <br />system. Even if the project with Sam Houston State University is discontinued, it is most likely <br />that the City would continue to utilize a microcomputer platform for its Police Department <br />automation. j\;fr. Guerra asked how many total computers this would make at the police <br />department and Chief Kendrick stated fifty-one. The Council then voted unanimously for <br />adoption of the Resolution (Nfr. BABBIT LAWSUIT REGARDING THE RECOVERY OF <br />COSTS OF LITIGATION; AUTHORIZING THE CITY'S LEGAL COUNSEL TO <br />EXECUTE THE AGREEj\fENT ON BEHALF OF THE CITY; AND DECLARlNG AJ.~ <br />EFFECTIVE DATE. <br />
