3 Regular Meeting July 22~ 1996 Page 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AWARDING CONTRACTS FOR ANALYTICAL SERVICES FOR THE WASTEWATER TREATMENT PLANT TO AQUA-TECH, ALAMO-AQUATICS, SOUTHWEST TEXAS STATE UNIVERSITY, NET, AND PSI, INC.; AUTHORIZING THE PURCHASING MANAGER TO EXECUTE CONTRACT DOCUMENTS ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. r-: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, ¡ TEXAS, APPROVING AMENDMENT NO.1 TO THE CONSTRUCTION CONTRACT , FOR THE CITY OF SAN MARCOS BUILDING RENOVATION PROJECT; APPROVING FINAL PAYMENT TO STOKES CONSTRUCTION COMPANY FOR THE COMPLETION OF THE CITY OF SAN MARCOS BUILDING RENOVATION PROJECT; ACCEPTING THE PROJECT FOR USE BY THE CITY; AUTHORIZING FINAL PAYMENT IN THE AMOUNT OF $101,983.25; AND DECLARING AN EFFECTIVE DATE. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT BETWEEN THE CITY AND DAVID M. GRIFFITH AND ASSOCIATES, LTD. FOR A USER FEE STUDY; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LETTER AGREEMENT BETWEEN THE CITY AND AMERICAN MUNICIPAL SERVICES CORPORATION TO EXTEND A MUNICIPAL COURT CITATION COLLECTION AGREEMENT FOR A PERIOD OF ONE YEAR; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. Mayor Moore introduced for consideration Item 6.C. removed from the I consent agenda, removal from the table and adoption of a Resolution, the caption which was read as follows: I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING A PARTIAL RELEASE OF ABSTRACT OF JUDGMENT FOR PROPERTY AT 410 BROADWAY STREET PURCHASED BY MR. HENRY GARZA; AUTHORIZING THE CITY MANAGER TO SIGN THE PARTIAL RELEASE OF ABSTRACT OF JUDGMENT; AND DECLARING AN EFFECTIVE DATE. Mr. Guerra moved to remove this matter from the table and'for adoption of the Resolution and Mr. Hernandez seconded the motion. Mr. Guerra stated he understands the issue to be whether or not to accept $2,000.00 as the City's total settlement when the City is owed $36,000.00. Mr. Hart stated he felt ten cents on the dollar would be light and not a good settlement for the City. Mr. Cox asked if the City approves this amount, will we relinquish our rights for additional sales tax monies, and Mr. Taylor advised that - is correct. Mr. Cox stated he agrees with Mr. Hart's assessment that we should try to do better than ten cents on the dollar. Mr. Taylor advised the City has a good lien on this property, which was filed prior to the IRS filing a lien. Mr. Hernandez stated to Mr. Hart if the City does not go through with this, we will still have our lien on the property. Mr. Hart stated the CAD has appraised , this property as an asset worth $151,000.00. To clear the title to I the property, these issues need to be resolved. Mr. Hart stated he is not interested in ten cents on the dollar on this property. He I I is more in favor of a settlement such as ninety cents on the dollar. '- He stated he does not think it is appropriate to negotiate this matter in a Council Meeting and stated we needed to let the City Attorney do that, and either vote up or down and give direction. Mr. Cox moved to table this matter with direction for the City Manager and City Attorney to negotiate a more equitable arrangement for the taxpayers and Ms. Hughson seconded the motion. On roll call the following vote was recorded: AYE: Mihalkanin, Hughson, Hart, Cox. NAY: Moore, Guerra, Hernandez. ABSTAIN: None.
