<br />8. <br /> <br /> <br />Regular Meeting December 161 1996 Page 8 <br /> <br />Mayor Moore introduced the City Manager1s Report. Mr. Gilley <br />advised Fire Chief a/Leary had received a donation of $20,000.00 for <br />equipment which is used for the purpose of firefighters actually <br />being able to see in heavy smoke environments. The donation was <br />from an individual who does not live in San Marcos but has family <br />living in San Marcos. <br /> <br />Mayor Moore introduced the City Attorney/s Report. Mr. Taylor <br />wished Merry Christmas to everyone. <br /> <br />Mayor Moore introduced the City Council/s Report. (1) Mr. <br />Mihalkanin advised the preliminary report from the Mayor1s Blue <br />Ribbon Committee on Tourism Development has been provided to the <br />Council in their mail boxes. A determination of the group is the <br />belief a more permanent body dealing with tourism product <br />development issues is needed. There was not a consensus where this <br />entity should be housed. The Committee thought the issue was too <br />important for the Committee to make that recommendation and <br />requested the City Council review the report and (1) if the Council <br />thinks there should be a permanent body 1 and (2) what the Council/s <br />judgment is. The Committee will go into the community and discuss <br />the work they have done. Mr. Mihalkanin will discuss the report and <br />the group with the Noon Kiwanis on January 10. The Committee still <br />has a few more months of work left. Mayor Moore asked Mr. Gilley <br />and Staff to also be reviewing the report to make their <br />recommendations as well. (2) Ms. Hughson stat.ed the Edwards Aquifer <br />Authority elected officers last week and Mike Beldon will continue <br />as Chair. (3) Ms. Hughson hopes the Council will have a more <br />lengthy discussion about the tower situation. It is her <br />understanding there will be more of these towers going UPI and the <br />City will be dealing with these requests. She thinks there needs to <br />be a process and for neighborhoods to be notified when something is <br />going inl similar to a zoning change occurring. Mayor Moore thinks <br />it does merit further discussionl and Mr. Gilley stated the <br />Telecommunications Act limits City/s ability to prohibit them and <br />only to regulate them. <br /> <br />Mayor Moore introduced an Executive Session pursuant to the <br />Government Codel Section 551.0711 to discuss pending litigation <br />(Kencon vs. City of San Marcos; Sierra Club vs. San Antonio) and <br />matters where the City Attorney/s ethical duty to the City clearly <br />conflicts with Government Code Chapter 551 (Airport economic <br />development proposal). Mr. Guerra moved to adjourn into Executive <br />Session at 9:12 p.m. and Ms. Hughson seconded the motionl which <br />passed unanimously. <br /> <br />Mr. Hernandez moved to reconvene at 10:04 p.m. and Mr. Guerra <br />secondedl which passed unanimously. <br /> <br />The meeting adjourned at 10:15 p.m. on motion made by Mr. Hernandez <br />and seconded by Mr. Mihalkanin. <br /> <br />fJ~9, ~ <br /> <br />'- Billy G.
