He stated they <br />already have adequate roads, police and fire protection and facilities for water. He stated he felt <br />this was taxation without representation. Dave Taylor, Green Guy Recycling, stated he sees lots <br />of waste recycled. He stated he did not want to see all this waste go into the landfills, but felt that <br />would happen without the Green Guy Program. <br />-- <br />Mayor Moore introduced for consideration approval of a board appointment to the Human <br />Services Advisory Board. Ms. Hughson moved to appoint Carroll David, which passed <br />unanimously. <br />Mayor Moore introduced for consideration approval of a board appointment to the Convention & <br />Visitors Bureau. Mr. Hernandez was not present to make his appointment. Mr. Guerra stated he <br />would have a recommendation for Mr. Hernandez at the next meeting if he did not have a name. <br />Mayor Moore introduced for consideration approval of a board appointment to the Main Street <br />Advisory Board. Mr. Cox moved to appoint Bob Sappington, which passed unanimously. <br />Mayor Moore introduced for consideration approval of four appointments to the Planning & <br />Zoning Commission. Ms. Hughson moved to reappoint Mike Davis and John Wade and to <br />appoint Ronald Pope. Mr. Guerra moved to reappoint Margie Moore, which passed <br />unanimously. <br />Mayor Moore introduced for consideration a public hearing and approval of an Ordinance on first <br />reading, the caption which was read as follows: <br />AN ORDNANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTIONS 114.516 AND 114.517 OF THE CITY CODE TO <br />REQUIRE SPECIFIC USE PERMITS FOR CERTAIN COMMERCIAL RETAIL OR <br />WHOLESALE USES WITHIN "LI" LIGHT INDUSTRIAL DISTRICTS; AMENDING <br />SECTION 114.578 OF THE CITY CODE REGARDING MEASUREMENT OF THE <br />OFFSET DISTANCE BETWEEN PUBLIC SCHOOLS AND BUSINESSES SELLING <br />ALCOHOLIC BEVERAGES; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. No one did so <br />Mayor Moore closed the public hearing. Mr. Guerra moved for approval of the Ordinance on <br />first reading and Mr. Hart seconded the motion. Mr. Guerra asked if the public hearing was a <br />requirement. Mr. Patterson stated this was a state requirement in the permitted use process. Mr. <br />Hart questioned the discussion earlier over the use of deed restrictions in this process. Mr. <br />Patterson stated SUP's could be allowed for long periods of time and he would not have to renew <br />them unless something changed affecting the SUP. Mr. Hart asked if the Commission considered <br />changing the definition of "LI" District. Mr. Patterson stated the use would become questionable <br />and he felt the public hearing process was the way to go. Ms. Hughson asked about the business <br />park zoning. Mr. Patterson stated staff would be getting together with the owners for feedback <br />from them to see what they wanted and then the City could do initiated zoning once the needs of <br />the business owners is determined. Mr. Cox asked if the distance between public schools and <br />places that sell alcohol would conform with state law. Mr. Taylor stated that was correct. Ms. Hughson asked if heavy <br />commercial businesses were allowed in light industrial districts. Mr. Patterson stated he would <br />check and let Ms. Hughson know.
