On roll <br />call the following vote was recorded: <br /> AYE: Mihalkanin, Hughson, Moore, Guerra, Cox. <br /> NAY: Hart, Hernandez. <br />ABSTAIN: None. <br />Mayor Moore introduced for consideration Item 5, a public hearing <br />regarding an annexation, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 430 <br /> ACRES, MORE OR LESS, INCLUDING WILLOW CREEK ESTATES, SECTION 8, <br /> THE RIDGE AT WILLOW CREEK, SECTION 2, AND CERTAIN UNDEVELOPED <br /> AREAS ALONG PURGATORY CREEK GENERALLY LOCATED BETWEEN THE <br /> WESTOVER ADDITION AND WILLOW CREEK ESTATES; APPROVING A SERVICE <br /> PLAN FOR THIS TRACT; PROVIDING FOR PUBLICATION; AND DECLARING <br /> AN EFFECTIVE DATE. <br />Mayor Moore opened the public hearing. David Hanzel purchased <br />property in this area and stated police and fire woUld have to go <br />out of the City limits and back in to get to this property and asked <br />if the City would maintain the roads and if the County would keep <br />their roads up to standards. Mr. Gilley stated the City plans .to <br />provide police and fire protection and anticipate the County will <br />take care of their roads. Mr. Gilley stated the City is not <br />prohibited from using County roads to go to this area, and the City <br />will be responsible for maintaining roads. Mayor Moore referred to <br />the service plan and directed Mr. Hanzel to have Messrs. Gilley and <br />Patterson review plans with him. Mr. Hart asked how this area would <br />be patrolled, and Mr. Gilley stated this area would simply be <br />included within an existing patrol quadrant as an added <br />responsibility. Mr. Hart asked for fire response time, and Chief <br />O'Leary stated it would probably be from Central Fire Station and <br />the Broadway Station is about the same distance. Chief O'Leary <br />stated the City has good response times to some areas of town and <br />some not so good in other areas, and this area would not really be <br />outside some of our poorer response times. Mayor Moore stated it <br />has been stated the purpose is to take in residential property for <br />revenue purposes and asked Mr. Gilley to address this. Mr. Gilley <br />stated one of the reasons for annexation is for economic viability <br />of the City, and we anticipate there would be revenues collected <br />from property taxes on this area. It is also for systematic <br />controlled growth of the community and is in response to the <br />annexation plan the City has been working from since the adoption of <br />the San Marcos Horizons Plan. Greg Iglesia asked why the City was <br />annexing this property other than for tax revenues. Mr. Gilley <br />again stated for systematic control of the community, it is an area <br />in developmental stages, it meets our subdivision standards, all the <br />infrastructure is to City standards, and the economic impact is a <br />factor as well. Mr. Iglesia asked if Willow Creek met City <br />standards, and Mr. Gilley stated portions of the infrastructure do <br />not meet City standards, and portions do. Mr. Iglesia asked if all <br />utilities would be provided and Mr. Gilley stated all but wastewater <br />service at this time because there is no infrastructure in place. <br />Mr. Cox asked where infrastructure is not in place to provide <br />wastewater service if the City does inspect the septic system, and <br />Mr. Gilley stated yes. Mr. Taylor also pointed out the development <br />density in this area is not as great as in most areas of town, and <br />because of the large lot sizes, septic tanks are permitted where <br />within the City smaller lot sizes would not permit that to be done. <br />Mike Dishman stated 100 acres along Purgatory Creek is in the <br />floodplain and could not be developed, so he stated he thought it <br />was a lot of tax that would have to be paid on this property when <br />that land cannot be used for anything and have to pay taxes on it. <br />Ms. Hughson stated compensation is provided when land is taken by an <br />agency for flood control, and Mr. Gilley responded he thought Col. <br />Dishman was referring to the flood control structure, but in areas <br />in the floodplain there are provisions to allow for development with <br />some restrictions on development.
