ORDINANCE NO. 2016-51 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AMENDING ORDINANCE NO. 2014-70 <br /> CONSENTING TO THE CREATION OF COTTON CENTER <br /> MUNICIPAL UTILITY DISTRICT NO. 1 WITHIN THE CITY'S <br /> EXTRATERRITORIAL JURISDICTION TO PROVIDE FOR AN <br /> AMENDMENT TO THE CONSENT AGREEMENT TO EXTEND THE <br /> DATE FOR THE REQUIRED CREATION OF A SUBDISTRICT TO <br /> WITHIN SIXTY MONTHS FROM THE DATE OF THE <br /> CONFIRMATION ELECTION; AND PROVIDING FOR AN EFFECTIVE <br /> DATE. <br /> RECITALS: <br /> 1. The City of San Marcos, upon receiving a Petition for Consent to the Creation of <br /> a Municipal Utility District No. 1 for 2,358 acres currently located in the City's <br /> extraterritorial jurisdiction, granted consent for the creation of Cotton Center <br /> Municipal Utility District No. 1 on December 14, 2014. <br /> 2. The Texas Legislature authorized the creation of Cotton Center Municipal Utility <br /> District No. 1 with the passage of House Bill 1372, during the Regular 84th <br /> Legislative Session, effective June 1, 2015. <br /> 3. As authorized by the Legislation, an election to confirm the creation of the <br /> District and the election of permanent directors was held on May 7, 2016. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The City Council of the City of San Marcos, Texas approves the First <br /> Amendment to the Consent Agreement for the Creation of the Cotton Center Municipal Utility <br /> District, attached as Exhibit A, to extend the date of required creation of a Sub-District by three <br /> years to provide that a Sub-District must be created within sixty (60) months from the date of the <br /> confirmation election which occurred on May 7, 2016. <br /> SECTION 2. The City Manager is authorized to execute the First Amendment to the <br /> Consent Agreement for the Cotton Center Municipal Utility District. <br /> SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in <br /> conflict with this ordinance are repealed. <br /> SECTION 4. . This ordinance shall be effective upon passage and adoption on second <br /> reading. <br /> PASSED AND APPROVED on first reading on December 6, 2016. <br />
