RESOLUTION NO. 2016-182R <br /> RESOLUTION OF THE CITY OF SAN MARCOS, TEXAS <br /> REQUESTING THAT THE TEXAS STATE LEGISLATURE <br /> AND THE GOVERNOR OF TEXAS TAKE ACTION <br /> DURING THE REGULAR SESSION OF THE 85TH TEXAS <br /> LEGISLATURE TO APPROVE LEGISLATION BY THE <br /> HONORABLE REPRESENTATIVE TOM CRADDICK AND <br /> SENATOR JUDITH ZAFFIRINI RELATING TO THE <br /> CREATION OF AN OFFENSE FOR USE OF A HANDHELD <br /> WIRELESS COMMUNICATION DEVICE FOR TEXT- <br /> BASED COMMUNICATION WHILE OPERATING A <br /> MOTOR VEHICLE. <br /> WHEREAS,the citizens of the City of San Marcos are deeply concerned about the <br /> public safety and the harmful effects on the roadways due to drivers texting on a handheld <br /> wireless communication device while operating a motor vehicle; and <br /> WHEREAS, nearly one in five crashes are the result of some type of driver distraction; <br /> and <br /> WHEREAS, the lives lost and the economic cost due to a distracted driving crash are <br /> completely preventable; and <br /> WHEREAS, it is important to have consistent regulations so that the people of Texas can <br /> have a clear understanding of what is expected while traveling in a vehicle through each <br /> municipality; and <br /> WHEREAS, the City Council finds that safe roadways promote and protect the public <br /> health, safety and welfare of the citizens of San Marcos; and <br /> WHEREAS, the City of San Marcos sees a serious safety issue in our community and it <br /> is vital that the Texas State Legislature and the Governor take immediate action to address the <br /> issue; <br /> NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS: <br /> SECTION ONE. That the Texas State Legislature is encouraged to take prompt action in <br /> the 85th Session of the Texas Legislature to approve legislation by Representative Tom Craddick <br /> and Senator Judith Zaffirini relating to the creation of an offense for use of a handheld wireless <br /> communication device for text-based communication while operating a motor vehicle. <br /> SECTION TWO. That the Governor of Texas is hereby encouraged to sign legislation <br /> relating to the creation of an offense for use of a handheld wireless communication device for <br />
