RESOLUTION NO. 2017-14R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS GRANTING A PETITION FOR THE VOLUNTARY <br />ANNEXATION OF 17.45 ACRES, MORE OR LESS, OF LAND <br />SITUATED IN THE CYRUS WICKSON SURVEY, ABSTRACT NO. 474, <br />LOCATED IN HAYS COUNTY ON EAST MCCARTY LANE, WEST OF <br />RATTLER ROAD (PROPOSED SITE OF THE SAVOY APARTMENTS); <br />DIRECTING CITY STAFF TO PREPARE A SERVICE PLAN FOR SUCH <br />AREA OF LAND; APPROVING A PROPOSED MEETING SCHEDULE <br />FOR PUBLIC HEARINGS REGARDING AND CONSIDERATION OF AN <br />ORDINANCE ANNEXING SUCH AREA OF LAND; AND DECLARING <br />AN EFFECTIVE DATE. <br />RECITALS: <br />1. Pursuant to Section 43.028 of the Texas Local Government Code, a petition (the <br />"Petition") has been submitted for the voluntary annexation of that certain 17.45 acres, more or <br />less, of land situated in the Cyrus Wickson Survey, Abstract No. 474, located in Hays County on <br />East McCarty Lane, west of Rattler Road, more particularly described in Exhibit "A," attached <br />hereto (the "Property"). <br />2. The Property is contiguous the existing San Marcos city limits. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The Petition is hereby granted. <br />PART 2. The proposed meeting schedule for public hearings regarding and <br />consideration of an ordinance annexing the Property, attached hereto as Exhibit "B," is approved. <br />PART 3. The City's planning staff is directed to prepare a service plan for the <br />provision of city services to the Property in the event the Property is annexed. <br />PART 4. By approval of this resolution, the City Council makes no representations <br />regarding future actions or the likelihood of outcomes concerning the approval of requests <br />related to the Property including, but not limited to requests for annexation, zoning and housing <br />tax credits. <br />PART 5. This resolution shall become effective immediately from and after its <br />passage. <br />
