City Council Meeting Minutes February 7,2017 <br /> Mr. Higdon,continued with the petitions that were presented to the Council <br /> have over 1000 signatures on them. He provided that they have received the <br /> support of Staff and the Planning and Zoning Commission who voted 5 to 1 in <br /> favor of the CUP. He implored the Council to honor the intent of the T5 zone. <br /> He stated that they have invested a great deal of money and time to improve <br /> downtown. He asked that the Council honor the CUP that was granted. <br /> Pat Phol,207 East Mimosa Circle, stated that she was present with three of her <br /> Alpha Delta Pi sisters. She spoke about the sorority house next door to the new <br /> Gumby's location and how it is a home. She stated that in the sorority house <br /> alcohol is prohibited by the university and the Alpha Delta Pi Charter. She <br /> stated that years ago Alpha Delta Pi invested in the historic house on the <br /> property and recently invested to add additional meeting space as well. She <br /> stated that the sorority pays property taxes, their members must maintain <br /> higher GPA than what is required by the university, and that they raise 1000's <br /> of dollars for charities both locally and federally. <br /> Linda Gilcrease, Old Ranch Road 12,was the Chapter Adviser at Alpha Delta <br /> Pi, she spoke about concerns for their safety and also she spoke about her love <br /> for Pizza, but felt this is not the place for that. <br /> Debbie Austin, 101 (inaudible), She spoke about her concern for the historic <br /> district if this CUP is maintained. She shared her opposition to the CUP and <br /> asked the Council to consider those people that are always involved vs. those <br /> that may only be present for this issue. <br /> Zach Hoffin,spoke in favor of Gumby's. He stated that when he moved to San <br /> Marcos in 2004 downtown was boarded up, but now it is vibrant. He stated <br /> that the places that serve alcohol have not run anything out of downtown. He <br /> stated that the Higdons have invested in this building and they are currently <br /> renting. He provided that alcohol is already legal in San Marcos and is served <br /> at many establishments in this area. He stated that AJ's is also open until 3am <br /> and that same drunken horde that has been reference previously are not <br /> causing problems there. He stated that Mrs. Dillon fought Zelick's for years, <br /> and now has a positive review on their Facebook page. <br /> Dianna baker, 727 Belvin, asked the Council to please protect these old <br /> buildings and make some sort of transition zone. <br /> Alex Robbins, 833 Old RR 12, spoke in support of Gumby's.
