Section 6.07 Waiver of Development Standards. Pursuant to the City's authority under <br />section 1.4.4.1 of the LDC, the City hereby waives the following requirements of the LDC: <br />a. Provisions applicable to Development Agreements under Chapter 1, Article 4, <br />Division 2. <br />b. As to the Project Site, the dimensional standards under Section 4.4.1.1(b) and <br />Sections 6.7.2.1(c) and 0) are waived to allow a flag lot configuration as shown in Exhibit "F." <br />C. As to the Project Site, the exterior construction and design requirements <br />under Section 4.4.2.2 of the LDC are waived to the extent they conflict with the building <br />construction and design proposed in Exhibit "H" attached hereto and incorporated herein. <br />Section 6.08 Other Cooperation. To the extent the City determines that public facilities <br />or infrastructure are required beyond what are necessary to serve all or portions of the Land as it <br />is developed or beyond what is roughly proportional for such development, the City will coordinate <br />with Developers in an effort to negotiate terms of an agreement for the City to participate in the <br />cost of any oversizing of such facilities or infrastructure requested by the City, if any, pursuant to <br />applicable laws and City policies for doing so. If the City and the Developers are unable negotiate <br />the terms of such an agreement for such cost participation by the City, the Developers shall not be <br />required to provide such oversized facilities or infrastructure. <br />ARTICLE VII <br />REPRESENTATIONS AND WARRANTIES <br />As of the Effective Date, Company represents and warrants to the City, as follows: <br />Section 7.01. Organization. The Company is duly organized under the laws of the State <br />of Delaware, validly existing and in good standing under the laws of the State of Texas and is <br />authorized to conduct business or own real property in the State of Texas. The activities that the <br />Company proposes to carry on at the Project Site may lawfully be conducted by Company. <br />
