ORDINANCE NO. 2017-22 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING THE INSTALLATION OF SPEED <br />CUSHIONS IN BOTH DIRECTIONS IN THE 500 THROUGH 600 BLOCKS <br />OF CANDLELIGHT LANE (FROM DEL SOL DRIVE TO BROADWAY); <br />AND INCLUDING PROCEDURAL PROVISIONS. <br />RECITALS: <br />1. Candlelight Lane is a two-way residential street. A traffic study indicates that <br />the 85th percentile speed in the 500 to 600 blocks of Candlelight Lane is 28.3 miles per hour <br />on weekdays and 27.6 miles per hour on weekends, both of which are in excess of the posted <br />speed limit of 25 miles per hour. <br />2. Such traffic conditions are not safe for residents and residents have petitioned <br />the City to install speed cushions on said blocks of Candlelight Lane. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Recitals are hereby found to be true and correct and are adopted as the <br />findings of the City Council. <br />SECTION 2. Pursuant to Section 82.066 of the San Marcos Code, on the basis of such <br />findings, the City Council hereby authorizes the installation of speed cushions in the 500 to 600 <br />blocks of Candlelight Lane (from Del Sol Drive to Broadway Drive). <br />SECTION 3. The installation of signs providing notice of the presence of the speed <br />cushions is also hereby authorized. <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br />SECTION 6. This ordinance shall be effective upon its adoption on second reading. <br />PASSED AND APPROVED on first reading on May 2, 2017. <br />PASSED, APPROVED AND ADOPTED on second reading on May 16, 2017. <br />
