State Procurement Requirements. All purchases for goods, services or commodities <br /> made with funds provided under this Agreement shall comply with State and local <br /> procurement and contracting laws. <br /> C. Disadvantaged Business Enterprises. The City agrees to comply with 40 CFR Part <br /> 33, relating to Participation by Disadvantaged Business Enterprises in United States <br /> Environmental Protection Agency Programs. <br /> D. Contracts for Architectural or Engineering Professional Services. The City agrees to <br /> comply with 33 U.S.C. § 1382(b)(14) (Section 602(b)(14) of the Federal Water <br /> Pollution Control Act), relating to Capitalization Grant Agreements and 40 U.S.C. §§ <br /> 1101 et seq., relating to the Selection of Architects and Engineers. <br /> ARTICLE IV. PLANNING,ACQUISITION,AND DESIGN <br /> 4.01. PROJECT REQUIREMENTS. The City shall comply with the following: <br /> A. Plans and Specifications. The City shall construct the Project in accordance with the <br /> plans and specifications as sealed by a State licensed engineer and as approved by <br /> the Executive Administrator in compliance with 31 TAC §§ 375.81 - 375.83. <br /> B. Changes to Plans and Specifications. The City shall not make or implement any <br /> changes to the scope of the Executive Administrator's approved Project or to the <br /> specifications for the Project including, but not limited to, changes to the Green <br /> Project Reserve portion of the Project without the written approval of the Executive <br /> Administrator. <br /> C. Project Schedule. The City shall adhere to the TWDB approved Project schedule, <br /> attached as EXHIBIT E, and shall timely and expeditiously use funds and complete <br /> the Project. The City shall not exceed or revise the Project schedule except upon <br /> written approval from the TWDB. The City shall not delay the Project completion <br /> date except by Amendment to this Agreement. <br /> D. Project Budget. The City shall be solely responsible for all costs that exceed the <br /> TWDB approved Project budget, attached as EXHIBIT F. The City shall notify the <br /> Executive Administrator immediately when it appears that the Project budget may <br /> not be sufficient to complete the Project.
