PART 2. Pursuant to Section 4.3.4.2(b)(3) of the Land Development Code, a <br /> conditional use permit variance is hereby granted to allow Komal Latin Kitchen and Bar to serve <br /> alcohol for on-site consumption from its location at 2550 Hunter Road. <br /> PART 3. The variance granted under Part 2 is subject to all applicable requirements <br /> of Section 4.3.4.2(b)(3) of the Land Development Code and the condition that the following be <br /> printed on the restaurant's menus: <br /> "Due to the close proximity of a school campus, please be alert for students and <br /> drive carefully. This restaurant will accommodate, as necessary,any individual that needs <br /> transportation after consuming alcoholic beverages." <br /> PART 4. The variance granted under Part 2 shall continue for the duration of an <br /> initial conditional use permit granted to Komal Latin Kitchen and Bar by the City's Planning and <br /> Zoning Commission in conjunction with this variance, subject to annual renewal of the conditional <br /> use permit in accordance with the requirements of Section 4.3.4.2(b)(3) of the Land Development <br /> Code. In the event an initial conditional use permit for the business is not approved, or an <br /> approved conditional use permit expires, is revoked or otherwise lapses, the variance granted <br /> herein shall terminate. <br /> PART 5.
