120 <br />Regular Meeting February 8, 1999 Page 5 <br />Mr. Cox moved for adoption of the Ordinance on emergency and Mr. Moseley seconded the <br />motion. On roll call the following vote was recorded: <br />AYE: Mihalkanin, Moore, Moseley, Cox. <br />NAY: Hughson, Doiron. <br />ABSTAIN: None. <br />The Ordinance received only four votes of approval and was therefore approved on first reading <br />rather than on emergency, which requires five votes. <br />Mayor Moore introduced for consideration the consent agenda including approval of Minutes of <br />the Regular Meeting held January 25, 1999, approval of two Ordinances on second reading, <br />adoption of Ordinance on third and final reading, adoption of six Resolutions and approval of <br />Change Order No. 3 for $153,530.00 for the Centerpoint Transmission Main Project for utility <br />relocation, on consensus. The Council removed item 8.D.(6), adoption of a Resolution, to be <br />considered separately. Mr. Doiron moved for approval of the Minutes of the Regular Meeting <br />held January 25, 1999, approval of two Ordinances on second reading, adoption of an Ordinance <br />on third and final reading, adoption of the remaining five Resolutions, and approval of Change <br />Order No. 3 for $153,530.00 for the Centerpoint Transmission Main Project for utility relocation, <br />on consensus. Mr. Cox abstained on item 8.D. (4). adoption of a Resolution. Ms. Hughson <br />seconded the motion, which passed unanimously. The caption of these Ordinances and <br />Resolutions read as follows: <br />Approval of Ordinances on second reading: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS AMENDING CHAPTER 62, PUBLIC SAFETY, OF THE CITY CODE BY <br />DELETING DIVISION 3, SPECIAL ASSIGNMENT SERVICES--OFF DUTY <br />SECURITY WORK, OF ARTICLE 2, POLICE DEPARTMENT; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE TRAFFIC REGISTER MAINTAINED UNDER SECTION <br />82.067 OF THE SAN MARCOS CITY CODE BY REVISING THE TIME PERIODS <br />FOR A 20 M.P.H. SCHOOL ZONE IN THE 300 BLOCK OF NORTH STREET; <br />INCLUDING PROCEDURAL PROVISONS; AND PROVIDING FOR PENALTIES. <br />Adoption of Ordinance on third and final reading: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS UPDATING AND CLARIFYING CHAPTER 42, HISTORIC <br />PRESERVATION, OF THE SAN MARCOS CITY CODE; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Adoption of Resolutions: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING A LICENSE AGREEMENT BETWEEN THE CITY AND THE <br />SCHEIB OPPORTUNITY CENTER FOR THE USE OF A PORTION OF DELMAR <br />STREET FOR THE PURPOSE OF PROVIDING DRIVEWAY ACCESS; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE LICENSE <br />AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING A REVISED AGREEMENT BETWEEN THE CITY AND <br />JEFFREY H. KESTER & ASSOCIATES FOR PROFESSIONAL ARCHITECTURAL <br />SERVICES IN CONNECTION WITH THE TOURIST INFORMATION CENTER
