RESOLUTION 2017-112R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING THE APPOINTMENT OF THE LAW <br /> FIRM OF DAVIDSON TROILO REAM & GARZA AS SPECIAL <br /> COUNSEL TO ADVISE THE ETHICS REVIEW COMMISSION AS IT <br /> CONSIDERS A REQUEST FROM COUNCIL MEMBER ED <br /> MIHALKANIN FOR AN ETHICS ADVISORY OPINION; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. On July 5, 2017 Council Member Ed Mihalkanin submitted a request to the San <br /> Marcos Ethics Review Commission for an advisory opinion regarding his ability to vote on <br /> matters pertaining to expansion of the Hopkins Street and Lindsey-Rogers Historic Districts or <br /> any proposed Lindsey Hill development, zoning, or land use request. A copy of his request for <br /> an advisory opinion is attached to this resolution as Exhibit "A". <br /> 2. Section 2.445 of the San Marcos City Code requires the city council to appoint an <br /> independent outside attorney as special counsel to the Ethics Review Commission when an <br /> advisory opinion is requested by a council member. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. Mr. Frank Garza, with the firm of Davidson Troilo Ream & Garza is <br /> hereby approved as special counsel to the Ethics Review Commission regarding Council <br /> Member Ed Mihalkanin's request for an advisory opinion under the terms stated in the law firm's <br /> proposal attached to this resolution as Exhibit"B." <br /> PART 2.
