ORDINANCE NO. 2017-25 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS CREATING A TWO-HOUR PARKING <br />RESTRICTION BETWEEN THE HOURS OF 8:00 A.M. AND 5:00 P.M. <br />MONDAY THROUGH FRIDAY IN THE GENERAL AREA OF <br />DOWNTOWN SAN MARCOS AS AUTHORIZED BY SECTION 82.160 OF <br />THE SAN MARCOS CITY CODE AND AMENDING THE TRAFFIC <br />REGISTER TO REFLECT SUCH PARKING RESTRICTION; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br />RECITALS: <br />1. Section 82.160 of the San Marcos City Code allows the placement of signs on <br />public streets or in a public area giving notice that parking is limited to a specified time. <br />2. The designation of a two-hour parking zone in the general area of downtown is in <br />the interest of the public health, safety and welfare. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. A two-hour parking zone, to be in effect between the hours of 8:00 a.m. <br />and 5:00 p.m. Monday through Friday, is hereby designated on both sides of the road beginning <br />at the junction of South Guadalupe Street and the Union Pacific Railroad right-of-way (point of <br />origin), continuing north and east along said Union Pacific right-of-way to South CM Allen <br />Parkway, continuing north on South CM Allen Parkway to University Drive, continuing west on <br />University Drive to North LBJ Drive, continuing north on North LBJ Drive to Woods Street, <br />continuing west on Woods Street to North Comanche Street, continuing south on North <br />Comanche Street to Lindsey Street, continuing west and south on Lindsey Street to Moore Street, <br />continuing south and east on Moore Street to North Street, continuing south on North Street to <br />West San Antonio Street, continuing north and east on West San Antonio Street to Comanche <br />Street, continuing south on Comanche Street to Martin Luther King Drive, continuing east on <br />Martin Luther King Drive to South Guadalupe Street, continuing south on South Guadalupe <br />Street to the point of origin as depicted in Exhibit A. <br />SECTION 2. The two-hour parking zone established under Section 1 does not apply to <br />designated loading zones or residential permit areas established by previous ordinances. <br />SECTION3. The Traffic Register maintained under section 82.067 of the San Marcos <br />City Code is amended to reflect the two-hour parking designation established under Section 1. <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />
