Section 570.614; <br /> 9.8.1.10 All applicable standards, orders, or requirements issued under the Clean Air Act (42 <br /> U.S.C.7401-7671q), and the Federal Water Pollution Control Act(33 U.S.C. 1251-1387, as <br /> amended, and Environmental Protection Agency (EPA) regulations pursuant to 40 CFR Part 50, <br /> as amended <br /> 9.8.1.11 Mandatory standards and policies relating to energy efficiency which are contained in <br /> the state energy conservation plan issued in compliance with the Energy Policy and Conservation <br /> Act(PUB L 94-163, 89 Stat. 871) codified at 42 U.S.C.A. Section 6321 et seq.; <br /> 9.8.1.12 National Environmental Policy Act("NEPA") including Environmental Protection <br /> Agency regulations (40 C.F.R. Part 15), applicable HUD regulations set forth in 24 C.F.R. Parts <br /> 50 and 58 including authorities cited therein, and National Historic Preservation Act of 1966, <br /> including Federal Historic Preservation Regulations (36 C.F.R. Part 800), which require <br /> environmental clearance of federal aid projects; and in connection with NEPA requirements, <br /> Contractor is responsible for the preparation of NEPA documents required for environmental <br /> clearance of the Project covered hereunder; 24 C.F.R. Section 5.105, including applicable <br /> authorities cited therein, as well as applicable provisions of 24 C.F.R. Part 58, including Section <br /> 58.5 and applicable authorities cited therein and Section 58.6 and applicable authorities cited <br /> therein. <br /> 9.8.2 AFFIRMATIVE ACTION—WOMEN-AND MINORITY-OWNED BUSINESSES <br /> (W/MBE) <br /> The Contractor will take all necessary affirmative steps to afford small businesses, <br /> minority business enterprises, and women's business enterprises the maximum <br /> practicable opportunity to participate in the performance of this contract. As used <br /> in this contract, the terms "small business"means a business that meets the <br /> criteria set forth in section 3(a) of the Small Business Act, as amended (15 U.S.C. <br /> 632), and "minority and women's business enterprise" means a business at least <br /> fifty-one (51) percent owned and controlled by minority group members or <br /> women. For the purpose of this definition, "minority group members" are Afro- <br /> Americans, Spanish-speaking, Spanish surnamed or Spanish-heritage Americans, <br /> Asian-Americans, and American Indians. The Contractor may rely on written <br /> representations by businesses regarding their status as minority and female <br /> business enterprises in lieu of an independent investigation. <br /> Affirmative steps must include: <br /> i. Placing qualified small and minority businesses and women's business <br /> enterprises on solicitation lists; <br /> ii.
