a. Any completed supplies and/or partially completed supplies and materials that the Contractor has
<br /> specifically produced or specially acquired for the performance of the terminated part of the
<br /> agreement.
<br /> b. Upon such termination the Consultant will:
<br /> i. Stop work to the extent specified;ii. Terminate any subcontractors as
<br /> they relate to the terminated work; iii. Be paid for all work performed to
<br /> date;
<br /> c. The Contractor will not be paid for any work performed or costs incurred that reasonably could have
<br /> been avoided.
<br /> Section 3.Copeland Anti-Kickback Act Compliance.The Contractor shall comply with the requirements of 40 U.C.S. 3145,
<br /> as supplemented by 29 C.F.R. Part 3 (the Copeland Act).The "Anti-Kickback" section of the Act precludes a contractor or
<br /> subcontractor from inducing, by any means, any person employed in the construction, completion, or repair of public
<br /> work, to give up any part of the compensation to which he or she is otherwise entitled. All suspected or reported
<br /> violations must be reported to HUD.
<br /> Section 4. Civil Rights/ADA Compliance.The Contractor shall provide all work required under this Contract in a manner
<br /> that complies with the Civil Rights Act of 1964, as amended, Title VII of the Civil Rights Act of 1968 as amended, Section
<br /> 104(b)and Section 109 of Title 1 of the Housing and Community Development Act of 1974 as amended,Section 504 of the
<br /> Rehabilitation Act of 1973, the Americans with Disabilities Act of 1990, the Age Discrimination Act of 1975, Executive
<br /> Order 11063 as amended by Executive Order 12259, and Executive Order 11246 as amended by Executive Orders 11375,
<br /> 11478, 120107,and 12086.
<br /> A. The Contractor shall not discriminate against any employee or applicant for employment based on race, color,
<br /> sex, age, religion, national origin or disability. Contractor also agrees that Contractor will not discriminate against
<br /> any individual or group based on race, color, sex, age, religion, national origin, or disability and in accordance
<br /> with 42 U.S.C.A. Section 53.09, 24 C.F.R. Parts 1, 6 and 8 as they relate to discrimination, 41 C.F.R. Part 60 and
<br /> Executive Order No. 11246 as amended by Executive Order 11375, and all other applicable federal, state, and
<br /> local Equal Employment Opportunity and Affirmative Action rules, regulations and laws.
<br /> B. The Contractor shall comply with 42 U.S.C.A. Section 53.09 and 24 C.F.R. Parts 1, 6 and 8 as they relate to no
<br /> discrimination, Executive Order 11246 titled "Equal Employment Opportunity" as amended by Executive Order
<br /> 11375 (41 C.F.R. Part 60); and all other applicable federal, state and local Equal Employment Opportunity and
<br /> affirmative action rules, regulations and laws.
<br /> C. The Contractor, with regard to work performed by it during the term of this Contract, shall not discriminate on
<br /> the grounds of race, color,sex, age, religion, national origin or disability.
<br /> D. The contractor agrees to comply with all Federal regulations issued pursuant to compliance with 504 of the
<br /> Rehabilitation Act of 1973 (29 U.S>C. 7940 which prohibits discrimination against individuals with disabilities or
<br /> handicaps in any Federally assisted program.
<br /> E. In all solicitations either by competitive bidding or negotiation made by the Contractor for work to be performed
<br /> under subcontract, including procurement of materials or leases of equipment, each potential subcontractor or
<br /> supplier shall be notified by the Contractor of the Contractor's obligations under this Contract and the
<br /> regulations relevant to non-discrimination on the grounds of race, color, sex, age, religion, national origin, or
<br /> disability.
