PROFESSIONAL CONSULTING SERVICES AGREEMENT <br /> CONTRACT NUMBER: 217-448 <br /> This Agreement is effective the 06 day of September 2017, between the City of San <br /> Marcos,Texas,(the"City"), 630 East Hopkins, San Marcos,Texas 78666 and Freese and Nichols, <br /> Inc. (the "Engineer"), 10431 Morado Circle, Suite 300, Austin, Texas 78759, for the Engineers <br /> provision of engineering services in connection with the CDBG-DR Uhland Road Improvements <br /> Project ("Project"). <br /> The City and the Engineer agree as follows: <br /> ARTICLE 1 <br /> ENGINEER'S SERVICES (BASIC AND ADDITIONAL) <br /> AND RESPONSIBILITIES <br /> 1.0 STANDARDS OF PERFORMANCE <br /> 1.0.1 The Engineer is responsible for the proper, accurate and adequate delivery of services to <br /> develop plans, specifications, and opinions of probable construction cost for the Uhland Road <br /> Improvements including field investigations, local drainage improvements, reconstruction of <br /> Uhland Road, water and wastewater improvements, sidewalk improvements, environmental <br /> clearance, and construction phase support services in connection with the City's use of CDBG-DR <br /> funding that has been awarded directly to the City due to the May and October 2015 floods (the <br /> "Floods"). <br /> 1.0.2 The Engineer understands that the City has received funding for this Project from the <br /> United States Department of Housing and Urban Development (HUD) through the Community <br /> Development Block Grant - Disaster Recovery Program (CDBG-DR). This funding has been <br /> awarded directly to the City. Details regarding the utilization of this funding were published by <br /> HUD in the Federal Register Notice (PL-114-113). The Engineer will perform all of its services <br /> so that the Project will proceed in accordance with the detailed provisions of the Notice. <br /> 1.0.3 The Engineer's Basic Services consist of the services described in Sections 1.0 and 1.1 <br /> which include civil engineering services and the following services the Engineer will perform <br /> through subconsultants approved by City: <br /> (1) Desktop and field investigations necessary to complete the Environmental Review <br /> Record Checklist for a HUD EA project and providing supporting mapping and <br /> documentation. <br /> (2) Professional Land Surveying services including topographic survey, boundary survey, <br /> and preparation of easement and right-of-way documents, if needed. <br /> 1.0.4 The performance of all services by the Engineer in connection with this Agreement will be <br /> by persons appropriately licensed or registered under the State of Texas, local and Federal laws <br /> governing their respective consulting disciplines as applicable. In performing all services under <br /> this Agreement, the Engineer will use that degree of care and skill normally exercised for similar <br />
