"Assessment Ordinance" means each ordinance adopted by the City Council approving <br />this SAP (or amendments or supplements to the SAP) and levying the Special Assessments. <br />"Assessment Roll" means the Assessment Roll included in this SAP as Appendix A. which <br />may be updated, modified or amended from time to time in accordance with the <br />procedures set forth herein and in the PID Act, including updates prepared in connection <br />with the issuance of PID Bonds or in connection with any Annual Service Plan Update. <br />"Authorized Improvements" means improvements authorized by Section 372.003 of the <br />PID Act including those listed in Section IIIA of this SAP. <br />"City" means the City of San Marcos, Texas. <br />"City Council" means the City Council of City of San Marcos, Texas. <br />"County" means Hays County, Texas. <br />"Delinquency Reserve" has the meaning set forth in Section IV.I of this SAP. <br />"Delinquent Collection Costs" means interest, penalties and expenses incurred or <br />imposed with respect to any delinquent Special Assessment, or an Annual Installment <br />thereof, in accordance with the PID Act which includes the costs related to pursuing <br />collection of such delinquent Special Assessment, or an Annual Installment thereof, and the <br />costs related to foreclosing the lien against the Assessed Property, including attorney's fees. <br />"Indenture" means the applicable Indenture of Trust between the City and the Trustee <br />relating to the issuance of a series of PID Bonds for financing costs of Public Improvements, <br />as it may be amended from time to time. <br />"Landowners" means Yarrington Partners, Ltd., a Texas limited partnership, and Whisper <br />Master Community Limited Partnership, a Texas limited partnership. <br />"Land Use" means a use classification for final subdivided lots or final building Lots with <br />similar characteristics (e.g. commercial, light industrial, multifamily residential, single family <br />residential or other uses), as determined or approved by the Administrator. In the case of single <br />family residential Lots, the Land Use shall be defined by classifying the residential Lots with an <br />equal assessment based on an assumed average home price of $215,000. If any change in Land <br />Use requires a change in zoning or other entitlement process, such change must be approved by <br />the City prior to any change in the SAP. <br />4 <br />
