RESOLUTION 2017-146R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN AGREEMENT WITH ALAN PLUMMER ASSOCIATES, INC. FOR THE PROVISION OF PROFESSIONAL ENGINEERING SEVICES FOR THE RIVER ROAD PAVEMENT AND BANK STABILIZATION PROJECT IN THE AMOUNT OF $73,910 WHICH INCLUDES AN INCREASE OF $24,940 (ACIS NO. 2) ABOVE THE PREVIOUS NOT-TO- EXCEED CONTRACT AMOUNT OF $48,970; RATIFYING THE CITY MANAGER'S EXECUTION OF THIS AGREEMENT AND AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO SIGN AUTHORIZATION OF CHANGE IN SERVICES NO. 2; AND DECLARING AN EFFECTIVE DATE. RECITALS 1. On December 8, 2015 the City entered into an agreement (the "Agreement") Alan Plummer Associates, Inc. (the "Consultant") for the provision of professional engineering services in connection with the River Road Pavement and Bank Stabilization Project in a not-to- exceed amount of$46,866. 2. On June 12, 2016 ACIS No. 1 was approved to increase the not-to-exceed amount of the Agreement by$2,104 for a total of$48,970. 3. It is necessary to increase the contract amount due to increases in project scope, which will result in an increase of an additional $24,940 to the Agreement. 3. The approval of ACIS No. 2 for $24,940 will cause the amount of the Agreement to increase from $48,970 to $73,910 which exceeds the threshold for administrative approval and triggers the need for City Council's approval of the Agreement. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The Agreement between the City and Alan Plummer Associates, Inc. for the provision of professional engineering services in the not to exceed amount of $73,910, which includes an increase in price of$24,940, is approved. PART 2. The City Manager's execution of the Agreement on behalf of the City is ratified and the City Manager or his designee is authorized to execute ACIS No. 2 on behalf of the City. PART 3. This Resolution shall be in full force and effect immediately from and after its passage. 1
