ORDINANCE NO. 2017-50 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS INCREASING DRAINAGE UTILITY RATES AS <br /> AUTHORIZED BY SECTION 86.505 OF THE SAN MARCOS CITY <br /> CODE; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br /> AN EFFECTIVE DATE <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The City of San Marcos rates to be charged for the drainage utility fee <br /> authorized by Section 86.505 of the City Code for the fiscal year beginning on October 1, 2017 <br /> and ending on September 30, 2018 as shown on Exhibit A, attached hereto and incorporated for <br /> all purposes, are hereby approved. <br /> SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br /> held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br /> this ordinance will continue in force if they can be given effect without the invalid portion. <br /> SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br /> conflict with this ordinance are repealed. <br /> SECTION 5. This ordinance will become effective upon adoption and the new rates will <br /> be reflected on all utility bills issued on and after October 1, 2017. <br /> PASSED AND APPROVED on first reading on September 5, 2017. <br /> PASSED,APPROVED AND ADOPTED on second reading on September 19, 2017. <br /> Jo Thomaides <br /> Mayor <br /> Attest: Approved: <br /> Jo - Le- ase Mich -00".
