ORDINANCE NO. 2017-
<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS,
<br /> AUTHORIZING THE ISSUANCE AND SALE OF$34,270,000 FOR(1)CONSTRUCTING,
<br /> IMPROVING, EXTENDING AND EXPANDING CITY STREETS, BRIDGES,
<br /> SIDEWALKS, BIKE LANES, PEDESTRIAN LANES, BUS STOPS, PARKING, AND
<br /> RELATED TRAFFIC IMPROVEMENTS INCLUDING ACQUIRING ANY NECESSARY
<br /> RIGHTS-OF-WAY AND EQUIPMENT; (2) CONSTRUCTING, IMPROVING AND
<br /> EXTENDING THE CITY'S WATER AND WASTE WATER SYSTEM INCLUDING
<br /> ACQUIRING EQUIPMENT;(3)CONSTRUCTING,IMPROVING AND EXTENDING THE
<br /> CITY'S ELECTRIC UTILITY SYSTEM INCLUDING ACQUIRING EQUIPMENT; (4)
<br /> CONSTRUCTING,IMPROVING AND DESIGNING EXISTING MUNICIPAL BUILDINGS
<br /> TO INCLUDE THE ACTIVITY CENTER, CITY HALL, LIBRARY,
<br /> PUBLIC/COMMUNITY SERVICES BUILDING AND RELATED EQUIPMENT
<br /> PURCHASES; (5) CONSTRUCTING, DESIGNING, EQUIPPING AND RENOVATING
<br /> CITY PARKING FACILITIES; (6) CONSTRUCTING AND IMPROVING THE CITY'S
<br /> DRAINAGE AND FLOOD CONTROL FACILITIES; (7) CONSTRUCTING AND
<br /> IMPROVING THE CITY'S AIRPORT; (8) CONSTRUCTING,DESIGNING,EQUIPPING
<br /> AND RENOVATING PUBLIC SAFETY FACILITIES TO INCLUDE POLICE AND FIRE
<br /> STATION IMPROVEMENTS AND EQUIPMENT PURCHASES; (9) REPLACING,
<br /> IMPROVING, AND DEVELOPING THE DISASTER RECOVERY INFRASTRUCTURE
<br /> AND NETWORK INFRASTRUCTURE EQUIPMENT; (10) THE PAYMENT OF
<br /> PROFESSIONAL SERVICES IN CONNECTION THEREWITH INCLUDING LEGAL,
<br /> FISCAL AND ENGINEERING FEES AND THE COSTS OF ISSUING THE
<br /> CERTIFICATES OF OBLIGATION AND OTHER MATTERS RELATED THERETO
<br /> WHEREAS, the City Council (the "City Council") of the City of San Marcos, Texas (the
<br /> "City"), by resolution adopted on August 1, 2017, directed publication of notice of the City's
<br /> intention to issue interest bearing certificates of obligation in a total aggregate principal amount not
<br /> to exceed $34,670,000 for the purposes hereinafter set forth;
<br /> WHEREAS, such notice was published in the manner and to the extent required by law;
<br /> WHEREAS, there has not been filed with the City Clerk or any other officer of the City a
<br /> petition protesting the issuance of such certificates of obligation and requesting an election on same;
<br /> WHEREAS, it is affirmatively found and determined that the City is authorized to proceed
<br /> with the issuance and sale of such certificates of obligation as authorized by the Constitution and
<br /> laws of the State of Texas,including,particularly,Tex.Loc.Gov't Code Ann.Ch.271,subch.C,and
<br /> Tex. Gov't Code Ch. 1502; and
<br /> WHEREAS, it is officially found, determined and declared that the meeting at which this
<br /> Ordinance has been adopted was open to the public and public notice of the date, hour, place and
<br /> subject of said meeting, including this Ordinance, was given, all as required by the applicable
<br /> provisions of Tex. Gov't Code Ann. Ch. 551; Now, Therefore
