On roll call the following vote was recorded:
Guenther: Mihalkanin, Moore, Cox.
Frans: Hughson, Doiron, Moseley, Hernandez.
Mayor Moore introduced for consideration approval of an Ordinance on second reading, the
caption which was read as follows:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
TEXAS, ESTABLISHING THE CITY OF SAN MARCOS DRAINAGE UTILITY BY
AMENDING CHAPTER 86-UTILITIES OF THE SAN MARCOS CITY CODE TO
ADD ARTICLE 8 - DRAINAGE UTILITY; DEDICATING-CITY OWNED ASSETS
TO THE UTILITY; ESTABLISHING A SERVICE AREA FOR THE UTILITY;
AUTHORIZING THE PLANNING AND ENGINEERING DEPARTMENTS TO
PROMULGATE RULES AND REGULATIONS FOR THE EFFICIENT
ADMINISTRATION OF THE DRAINAGE UTILITY; ESTABLISHING THE
DRAINAGE ADVISORY BOARD BY AMENDING CHAPTER 2, ARTICLE 3,
DIVISION 7; AND PROVIDING AN EFFECTIVE DATE.
Mr. Cox moved for approval of the Ordinance on second reading and Mr. Mihalkanin seconded
the motion. Discussion ensued. Jerry Rademacher, who represents Butler Manufacturing, stated
Butler's property taxes are $326,000 annually and this fee will add an additional $15,000 to
Butler Manufacturing. He stated Butler spent ten million dollars to develop the park and seven
million of that was for the infrastructure of the park, which is currently a great drainage system.
During the flood the park held up very well because of this drainage system. He feels that
Butler's water will not go into San Marcos and currently spends $2,000 a month to maintain the
park, therefore, Butler is spending a significant amount of money to take care of the run-off
problem. Bill Haney, employee of Industrial Solvents, stated this type of fee for service is
probably the most aggressive that can be imposed for residential households. If the drainage
utility goes into effect it will need more representation than just five individuals for the drainage
utility board. Paul Reed, Vice President and Director of construction for Prime Retail, stated in
1989 Phase I at the mall constructed stormwater improvements, which was reviewed and
approved by the City Staff. Today Prime Outlets is constructing expansion to the mall under
permits that include permits from the Corps of Engineers, Texas Natural Resource Conservation
Commission and the City of San Marcos. These improvements will add additional stormwater
