Mayor Moore moved to appoint David Guenther as the social worker and Mr. Moseley <br />moved to appoint Helen Franks and Doug Frans. On roll call the following vote was recorded: <br />Guenther: Mihalkanin, Doiron, Moore, Cox. <br />Franks: Mihalkanin, Hughson, Moore, Moseley, Cox, Hernandez. <br />Frans: Hughson, Doiron, Moseley, Hernandez. <br />Helen Franks is appointed as a new member of this board and another vote was taken for the <br />Social Worker position. On roll call the following vote was recorded: <br />Guenther: Mihalkanin, Moore, Cox. <br />Frans: Hughson, Doiron, Moseley, Hernandez. <br />Mayor Moore introduced for consideration approval of an Ordinance on second reading, the <br />caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ESTABLISHING THE CITY OF SAN MARCOS DRAINAGE UTILITY BY <br />AMENDING CHAPTER 86-UTILITIES OF THE SAN MARCOS CITY CODE TO <br />ADD ARTICLE 8 - DRAINAGE UTILITY; DEDICATING-CITY OWNED ASSETS <br />TO THE UTILITY; ESTABLISHING A SERVICE AREA FOR THE UTILITY; <br />AUTHORIZING THE PLANNING AND ENGINEERING DEPARTMENTS TO <br />PROMULGATE RULES AND REGULATIONS FOR THE EFFICIENT <br />ADMINISTRATION OF THE DRAINAGE UTILITY; ESTABLISHING THE <br />DRAINAGE ADVISORY BOARD BY AMENDING CHAPTER 2, ARTICLE 3, <br />DIVISION 7; AND PROVIDING AN EFFECTIVE DATE. <br />Mr. Cox moved for approval of the Ordinance on second reading and Mr. Mihalkanin seconded <br />the motion. Discussion ensued. Jerry Rademacher, who represents Butler Manufacturing, stated <br />Butler's property taxes are $326,000 annually and this fee will add an additional $15,000 to <br />Butler Manufacturing. He stated Butler spent ten million dollars to develop the park and seven <br />million of that was for the infrastructure of the park, which is currently a great drainage system. <br />During the flood the park held up very well because of this drainage system. He feels that <br />Butler's water will not go into San Marcos and currently spends $2,000 a month to maintain the <br />park, therefore, Butler is spending a significant amount of money to take care of the run-off <br />problem. Bill Haney, employee of Industrial Solvents, stated this type of fee for service is <br />probably the most aggressive that can be imposed for residential households. If the drainage <br />utility goes into effect it will need more representation than just five individuals for the drainage <br />utility board. Paul Reed, Vice President and Director of construction for Prime Retail, stated in <br />1989 Phase I at the mall constructed stormwater improvements, which was reviewed and <br />approved by the City Staff. Today Prime Outlets is constructing expansion to the mall under <br />permits that include permits from the Corps of Engineers, Texas Natural Resource Conservation <br />Commission and the City of San Marcos.
