8 <br />Regular Meeting March 1, 1999 <br />Page 8 <br />of proof is on the person who is trying to engineer a project. <br />The Council requested copies of the proposed Drainage Ordinance <br />be provided to the Drainage Subcommittee. <br />Mayor Moore introduced the City Manager's Report. Mr. Gilley <br />had no report at this meeting. <br />Mayor Moore introduced the City Attorney's Report. Mr. Taylor <br />stated the City has received a decision on the bed and banks <br />proceeding. They have recommended our request to reuse <br />wastewater be granted with strict conditions. Mr. Taylor is <br />evaluating the decision now. It is not a final decision of <br />TNRCC. The final decision will be made April 28. <br />Mayor Moore introduced the City Council's Report. (1) Ms. <br />Hughson inquired about selection of a firm to do delinquent tax <br />collections. She wants to know what we agreed to, for how many <br />years, and if the City had input with the County in the criteria <br />to select a firm this year. Mr. Cox recalled it was left in the <br />hands of the County and the City wanted there to be a fair <br />selection with effectiveness. Mr. Gilley advised he did provide <br />criteria information to the County from the comments from the <br />Council. (2) Ms. Hughson asked to agendize a discussion <br />regarding the Hays County Commissioner's quest to get Austin's <br />ETJ out of Hays County. Mr. Cox stated he does not know if he <br />supports this but thinks the City should discuss it since the <br />County Judge made the request. Ms. Hughson also wants to know <br />what cities have supported this. Mr. Mihalkanin also wants <br />Austin contacted to let them know we would discuss this. (3) <br />Ms. Hughson requested a press release be prepared regarding <br />street information requested by March 31. (4) Mr. Cox inquired <br />if the Council received invitations to the Texas Independence <br />Day celebration at Miller tomorrow and stated he would try to be <br />in attendance if he could go if no other Council Member was able <br />to go. (5) Mr. Cox asked if any of the Council would be in <br />attendance at the Tanger opening of the Police Office, as he has <br />another commitment in Austin. Ms. Hughson stated she would be <br />present. (6) Mayor Moore asked if the Council had an interest <br />in him making a bid for the Economic Development and Community <br />Affairs Committee of the National League of Cities to hold a <br />meeting in San Marcos. He stated approximately 35 would come. <br />The Council expressed an interest in the invitation being <br />extended. (7) Mr. Mihalkanin asked the City Attorney if there <br />was any conflict between the Development Review Task Force and <br />the Planning and Zoning Commission, and Mr. Taylor advised there <br />was not. (8) Mr. Doiron invited the Council to the Youth <br />Workforce Development Meeting at TEF on Friday at 2:30 p.m. <br />They are putting together a fact sheet to take to businesses in <br />the community to get participation. (9) Mayor Moore advised the <br />Healthy Communities program will be forming task forces in the <br />community. Mr. Moseley stated the Economic Development Council <br />is taking a role in workforce development in general, not just <br />involving youth. (10) Mayor Moore stated there is concern in <br />the community regarding the death of the student last month that <br />there is a youth culture problem. Dr. Supple and Mr. Montenegro <br />are dialoguing with students to decide if a task force is <br />needed. <br />Mayor Moore introduced an Executive Session pursuant to the <br />Government Code, Chapter 551.071, to discuss matters where the <br />City Attorney's ethical duty to the City clearly conflicts with <br />Government Code chapter 551 (Gonzales properties tax lien; <br />wastewater reuse), and Sections 551.072 and 551.073, to discuss <br />exchange of real property (Comanche Wells replacement).
