<br /> l23 <br /> RESOLUTION 1997 - 3:.2?, R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN <br /> AGREEMENT FOR WASTEWATER SYSTEM IMPROVEMENTS BETWEEN <br /> THE CITY AND THE UNITED STATES DEPARTMENT OF LABOR FOR <br /> CONSTRUCTION AND MAINTENANCE OF UTILITY IMPROVEMENTS <br /> ADJOINING AND ABUTTING GARY JOB CORPS CENTER; WAIVING ALL <br /> PERMITTING, IMPACT AND INSPECTION FEES; AUTHORIZING THE <br /> CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE <br /> CITY AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The U.S. Department of Labor (DOL), on behalf of the Gary Job Corps Center, has <br /> asked the City of San Marcos to act as the project manager in the design and <br /> construction of a wastewater lift station and force main that will enable the Center <br /> to become a utility customer of the city. The Center is required by state and <br /> federal regulators to either upgrade its wastewater plant or cease operations. <br /> 2. Under the attached Agreement, the city will contract for the design and <br /> construction of the lift station and force main. The DOL will compensate the city <br /> for the design, construction and project administration. The DOL will also <br /> rehabilitate the Center's wastewater collection system according to the findings of <br /> a sewer system evaluation survey that will be conducted as part of the design <br /> effort. <br /> 3. On August 26, 1996, the City Council approved a resolution authorizing the City <br /> Manager to execute an agreement with the DOL for wastewater system <br /> improvements at Gary Job Corps Center. Due to changes in the contract <br /> requirements of the Department of Labor, that agreement was never executed. <br /> The attached Agreement is a revision of the one previously approved by City <br /> Council. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> PART 1. The terms and conditions of the attached Agreement for Wastewater <br /> System Improvements for the construction and maintenance of utility imp~ovements <br /> adjoining and abutting Gary Job Corps Center between the City and the United States <br /> Department of Labor are approved. <br /> PART 2. All permitting, impact and inspection fees the City would normally <br /> charge for the construction of this project and the connection of the Gary Job Corps <br /> Center to the City Wastewater System are waived. <br /> PART 3. The City Manager, Larry D. Gilley, is authorized to execute the <br /> agreement on behalf of the City. <br /> PART 4.
