The DOL agrees to <br /> reimburse the City within 30 days for change orders approved by the <br /> Project Manager in consultation with the DOL. The City will not make <br /> any changes that would cause the cost to DOL to exceed the original <br /> approved bid price without the approval of the DOL, including <br /> increases due to unforseen site conditions. The DOL agrees to <br /> approve or disapprove change orders within 3 working days or less <br /> after receipt of change orders submitted by the City. <br /> 5.02 The City and the DOL agree that the City has the right to expand or enhance <br /> the above noted facilities at the sole expense of the City. <br /> 5.03 It is the understanding of the parties that each will be entitled to have their <br /> own inspector or quality control person visit the worksite in advance and review the <br /> recommendations of the Engineer; provided however, if any of the inspector's or quality <br /> control personnel disagree with the recommendationš of the Engineer and the Engineer <br /> elects not to change his recommendations, the Engineer's recommendation will control and <br /> the parties will still have the obligation to pay their prorata share of all costs and expenses <br /> based upon the Engineer's recommendations. <br /> ARTICLE 6 <br /> WARRANTIES AND REPRESENTATIONS BY PARTIES <br /> 6.01 The City and the DOL warrant and represent to each other the following: <br /> (a) That each party has the power and authority to enter into and perform <br /> its duties and obligations under the Agreement. <br /> (b) That each party will promptly and timely pay its share of all required <br /> costs and expenses incurred under to this Agreement <br /> (c) That each party will provide all right-of-ways, easements or other <br /> access routes which are presently subject to their respective control <br /> C:\OFFICE\WPWI N\WP OOCS\MARIO.
