UN G AND APPROVING PUBLICATION OF SUCH NOTICE AND DIRECTING THE SECOND PUBLICA TION THEREOF; AJ.'fD CO NT AININ G OTHER PROVISIONS RELATING TO THE SUBJECT WHEREAS, by resolution adopted on May 19, 1997, this City Council directed publication of notice of its intention to issue waterworks and sewer system revenue bonds of the City of San Marcos, Texas (the "City"), not to exceed $1,590,000 in principal amount for the purpose of acquiring, constructing and installing additions, improvements and extensions to the City's waterworks and sewer system, at its meeting to commence at 7:30 P.M. on July 14, 1997; WHEREAS, notice of the City's intention to issue such revenue bonds was delivered to the newspaper with instructions for publication on June 20, 1997, and June 27, 1997, but such notice was published only on June 20, 1997; 'WHEREAS, in order to comply with legal requirements for the publication of such notice and to permit the issuance and sale of such bonds without further undue delay, notice of the City's intention to issue such bonds at the regular meeting of the City Council to be held at 7:30 P.M. on July 28, 1997, in form and content substantially as set forth in the Notice of Intention to Issue Revenue Bonds attached to this resolution and incorporated herein by reference, has been published one time prior to the meeting at which this resolution has been adopted and must be published a second time hereafter; and this City Council finds and determines that it is necessary and proper to approve the form and content of such notice, to ratify, confirm and approve the first publication of such notice prior to this meeting, and to authorize and direct 'the second publication of such notice; and WHEREAS, it is officially found and determined that the meeting at which this resolution has been considered and acted upon was open to the public and public notice of the time, place and subject of said meeting was given, all as required by T~x. Gov't Code Ann. ch 551; Now, Therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: Section 1. The statements contained in the preamble of this resolution are true and correct and are adopted as findings of fact and operative provisions hereof Section 2. The form and content of the Notice of Intention to Issue Revenue Bonds attached hereto are hereby approved. Section 3.
