Sec. 74.214 Installation and Inspections. <br />(a) A network provider shall, at its own cost and expense, install the network node, <br />network node facilities, node support poles and related ground equipment in a good and <br />workmanlike manner in accordance with this article. All work done in connection with the <br />installation, operation, maintenance, repair, modification, or replacement of the network node, <br />network node facilities, node support poles and related ground equipment shall be in compliance <br />with all applicable laws, ordinances, codes, rules and regulations of the city, state and federal <br />government. <br />(b) The City may perform visual inspections of any network node, network node, node <br />support pole or related ground equipment located in the right-of-way as deemed appropriate without <br />notice. If the inspection requires physical contact with the network node, node support poles or <br />related ground equipment, the city shall provide written notice to the network provider within five <br />business days of the planned inspection. The network provider may have a representative present <br />during the inspection. <br />(c) After completion of the work within the right-of-way, the network provider shall <br />provide to the city copies of maps and construction records of the permitted facilities as they are <br />actually constructed in the right-of-way and shall provide additional copies of the maps and records <br />to the city upon request. <br />City. <br />Sec. 74.215 Collocation. <br />A network provider shall collocate network nodes on poles pursuant to an agreement with the <br />Sec. 74.216 Replacement, Maintenance and Repair. <br />(a) A network provider shall provide the city with ten days advance written notice of the <br />following activities in the right-of-way: <br />(1) Routine maintenance that does not require excavation or the closing of sidewalks <br />or vehicular lanes; <br />(2) Replacement or upgrading a network node or pole with a network node or pole <br />that is substantially similar in size or smaller and that does not require excavation <br />or the closing of sidewalks or vehicular lanes; and <br />(3) The installation, placement, maintenance, operation, or replacement of network <br />nodes that are strung on cables between existing poles or node support poles <br />in compliance with the National Electrical Safety Code. <br />(b) A network provider shall comply with the requirements of this chapter and all other <br />applicable codes and ordinances, when installing, replacing, maintaining, repairing, upgrading, <br />removing, relocating or operating network nodes, network node facilities, node support poles and <br />related ground equipment. <br />
