ORDINANCE NO. 2017-66 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING THE TRAFFIC REGISTER <br />MAINTAINED UNDER SECTION 82.067 OF THE CITY CODE TO <br />ESTABLISH A TWO-HOUR PARKING RESTRICTION FROM 8:00 AM <br />TO 5:00 PM MONDAY THROUGH FRIDAY ON THE SOUTH SIDE OF <br />ACORN STREET FROM NORTH LBJ DRIVE TO CHESTNUT STREET <br />AS AUTHORIZED BY SECTION 82.160 OF THE CITY CODE; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br />RECITALS: <br />1. Section 82.160 of the San Marcos City Code allows the placement of signs on <br />public streets or in a public area giving notice that parking is limited to a specified time. <br />2. The designation of a two-hour parking zone Monday through Friday from 8:00 <br />a.m. to 5:00 p.m. on the south side of Acorn Street from North LBJ Drive to Chestnut Street is in <br />the interest of the public health, safety and welfare. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. A two-hour parking zone to be effective from 8:00 a.m. to 5:00 p.m. <br />Monday through Friday on the south side of Acorn Street from North LBJ Drive to Chestnut <br />Street as depicted on the map attached as Exhibit A is hereby established. <br />SECTION 2. The Traffic Register maintained under section 82.067 of the San Marcos <br />City Code is amended to reflect the two-hour parking designation established under Section 1. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 5. This ordinance shall be in effect upon adoption on second reading. <br />PASSED AND APPROVED on first reading on November 21, 2017. <br />PASSED, APPROVED AND ADOPTED on second reading on December 5, 2017. <br />
