ORDINANCE NO. 2017-66 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING THE TRAFFIC REGISTER MAINTAINED UNDER SECTION 82.067 OF THE CITY CODE TO ESTABLISH A TWO-HOUR PARKING RESTRICTION FROM 8:00 AM TO 5:00 PM MONDAY THROUGH FRIDAY ON THE SOUTH SIDE OF ACORN STREET FROM NORTH LBJ DRIVE TO CHESTNUT STREET AS AUTHORIZED BY SECTION 82.160 OF THE CITY CODE; AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. Section 82.160 of the San Marcos City Code allows the placement of signs on public streets or in a public area giving notice that parking is limited to a specified time. 2. The designation of a two-hour parking zone Monday through Friday from 8:00 a.m. to 5:00 p.m. on the south side of Acorn Street from North LBJ Drive to Chestnut Street is in the interest of the public health, safety and welfare. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. A two-hour parking zone to be effective from 8:00 a.m. to 5:00 p.m. Monday through Friday on the south side of Acorn Street from North LBJ Drive to Chestnut Street as depicted on the map attached as Exhibit A is hereby established. SECTION 2. The Traffic Register maintained under section 82.067 of the San Marcos City Code is amended to reflect the two-hour parking designation established under Section 1. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. This ordinance shall be in effect upon adoption on second reading. PASSED AND APPROVED on first reading on November 21, 2017. PASSED, APPROVED AND ADOPTED on second reading on December 5, 2017.
