100 <br />Regular Meeting April 12, 1999 Page 2 <br />Mr. Cox introduced for consideration approval of one appointment to <br />complete a vacancy on the Development Ordinance Review Task Force <br />(temporary). Mr. Mihalkanin moved to appoint Jim Byrn, which passed <br />unanimously. <br />Mr. Cox introduced for consideration approval of one appointment to <br />complete a vacancy on the Historic Preservation Commission. Mr. Moseley <br />moved to appoint Jeff Kester (representing art/design), which passed <br />unanimously. <br />Mr. Cox introduced for consideration a public hearing and adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOTS 58, 59 <br />AND 60 OF THE SOUTHEND ADDITION LOCATED AT 610, 614 AND 618 GEORGIA <br />STREET, FROM "M" (SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS <br />DISTRICT) TO "R-2" (SINGLE-FAMILY DWELLING DISTRICT [MEDIUM <br />DENSITY]); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />Mr. Cox opened the public hearing and asked if anyone wished to speak. No <br />one did, so Mr. Cox closed the public hearing. Ms. Hughson moved for <br />adoption of the Zoning Ordinance and Mr. Doiron seconded the motion, which <br />passed unanimously. <br />Mr. Cox introduced for consideration a public hearing and approval of an <br />Ordinance on first reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />GRANTING TO THE SAN MARCOS NOON LIONS CLUB A FRANCHISE TO OPERATE AND <br />MAINTAIN A TAXI SERVICE WITHIN THE CORPORATE LIMITS OF THE CITY FOR <br />THE PURPOSE OF TRANSPORTING PERSONS USING INNERTUBES TO AND FROM THE <br />SAN MARCOS RIVER; PRESCRIBING THE TERMS, CONDITIONS, OBLIGATIONS AND <br />LIMITATIONS UPON WHICH THE FRANCHISE SHALL BE EXERCISED AND <br />ESTABLISHING AN EFFECTIVE DATE. <br />Mr. Cox opened the public hearing and asked if anyone wished to speak. <br />Marcos Hernandez stated he is in support of this franchise. He stated the <br />Morning Lions Club wished to transfer the franchise to the Noon Lions Club <br />and they need to be in operation by May 1. Mr. Hernandez stated he was <br />present to answer any questions. No one else wished to speak, so Mr. Cox <br />closed the public hearing. Mr. Doiron moved for approval of the Ordinance <br />on first reading and Mr. Hernandez seconded the motion, which passed <br />unanimously. <br />Mr. Cox introduced for consideration a public hearing and approval of an <br />Ordinance on first reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE ABANDONMENT OF THE 15 FOOT ALLEYWAY LOCATED BETWEEN <br />LOTS 4 THROUGH 8 OF BLOCK 4 OF CEDAR PLATEAU ADDITION, LOCATED <br />ADJACENT TO THE 1300 BLOCK OF BROWN STREET; APPROVING THE CONVEYANCE <br />OF THIS ALLEYWAY TO ADJACENT PROPERTY OWNERS; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE DEEDS TO THE ABUTTING PROPERTY OWNERS; AND <br />DECLARING AN EFFECTIVE DATE. <br />Mr. Cox opened the public hearing and asked if anyone wished to speak. <br />Bibb Underwood stated he was representing the property owners and was <br />present to answer any questions. No one else wished to speak, so Mr. Cox <br />closed the public hearing. Mr. Doiron moved for approval of the Ordinance
