<br />107 <br />Regular Meeting July 12, 1999 Page 4 <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mr. Moseley moved to remove from the table and adoption of the Zoning Ordinance and Ms. <br />Hughson seconded the motion, which passed unanimously. <br />Mayor Moore introduced for consideration adoption of an Ordinance on third and final reading, <br />the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ESTABLISHING THE CITY OF SAN MARCOS DRAINAGE UTILITY BY <br />AMENDING CHAPTER 86 - UTILITIES OF THE SAN MARCOS CITY CODE TO <br />ADD ARTICLE 8 - DRAINAGE UTILITY; DEDICATING CITY-OWNED ASSETS <br />TO THE UTILITY; ESTABLISHING A SERVICE AREA FOR THE UTILITY; <br />AUTHORIZING THE PLANNING AND ENGINEERING DEPARTMENTS TO <br />PROMULGATE RULES AND REGULATIONS FOR THE EFFICIENT <br />ADMINISTRATION OF THE DRAINAGE UTILITY; ESTABLISHING THE <br />DRAINAGE ADVISORY BOARD BY AMENDING CHAPTER 2, ARTICLE 3, <br />DIVISION 7; AND PROVIDING AN EFFECTIVE DATE. <br />Mr. Hernandez moved for adoption of the Ordinance on third and final reading and Mr. Cox <br />seconded the motion. Discussion ensued. Mr. Mihalkanin moved to amend the second sentence <br />in Section 86.505 (e) to read, " The credit will be up to 50% of the drainage charge" and Mr. <br />Doiron seconded the motion, which passed unanimously. Mr. Rafael Gonzales stated he was for <br />and against this Ordinance. He feels there is a need for the drainage utility, but the Blanco River <br />brings water from other counties and backs up the water in San Marcos. The individuals who are <br />on fixed incomes cannot afford to have their utility bills any higher than they already are. Ms. <br />Hughson moved to amend Section 2.191 to add "The amount of credit will be determined by the <br />drainage advisory board after consultation with the director" and Mr. Cox seconded the motion, <br />which passed unanimously. Ms. Hughson moved to amend Section 2.193 (a) to add "...serves as <br />an advisory board to the city council and city staff concerning storm drainage needs" and Mr. <br />Moseley seconded the motion, which passed unanimously. Mr. Doiron moved to amend the <br />number of members to the Drainage Advisory Board from "seven" to "nine" and Mr. Moseley <br />seconded the motion, which passed unanimously. On roll call for adoption of the Ordinance, the <br />following vote was recorded: <br />A YE: Hughson, Moore, Cox, Hernandez, Mihalkanin. <br />NAY: Doiron, Moseley. <br />ABSTAIN: None. <br />Mayor Moore introduced for consideration seven appointments to the Drainage Advisory Board. <br />Mr. Hernandez moved to table the item to a later time in the meeting and Ms. Hughson seconded <br />the motion, which passed unanimously. <br />Mayor Moore introduced for consideration remove from table and adoption of a Resolution, the <br />caption which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS <br /> , <br />TEXAS, APPROVING THE ALLOCATION OF 1999 COMMUNITY <br />DEVELOPMENT BLOCK GRANT (CDBG) FUNDING; AUTHORIZING THE <br />PUBLICATION OF AN ACTION PLAN FOR THE 1999 CDBG FUNDING' <br /> , <br />AUTHORIZING THE CITY MANAGER TO ACT AS THE OFFICIAL <br />REPRESENTATIVE OF THE CITY TO ACT IN MATTERS RELATED TO THE <br />GRANT PROGRAM AND DECLARING AN EFFECTIVE DATE. <br />Mr. Doiron moved to remove from table and for adoption of the Resolution and Mr. Mihalkanin <br />seconded the motion. Discussion ensued. Mr. Doiron moved to amend Downtown Sidewalk <br />Project Phase ill funds from "$350,000.00" to "$325,000.00", $20,000.00 to fund the Greater <br />
