RESOLUTION 2018-49R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, MAKING APPOINTMENTS TO THE BOARD OF <br /> DIRECTORS OF THE ALLIANCE REGIONAL WATER AUTHORITY <br /> (ARWA), FORMALLY KNOWN AS THE HAYS CALDWELL PUBLIC <br /> UTILITY AGENCY; AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The governing bodies of the City of San Marcos, the City of Buda, the City of <br /> Kyle and the Canyon Regional Water Authority have adopted resolutions (the "Concurrent <br /> Resolutions") approving the creation of the Alliance Regional Water Authority (the "Authority") <br /> (formally known as the Hays Caldwell Public Utility Agency) in 2007 under the Texas Local <br /> Government Code Chapter 422, as amended (the "PUA Act"). During the 2017 Legislative <br /> Session, Senate Bill 1198 and House Bill 2540 were passed authorizing the name change from <br /> Hays Caldwell Public Utility Agency to Alliance Regional Water Authority. <br /> 2. The Concurrent Resolutions provide for the Authority to be governed by a Board <br /> of Directors (the"Authority Board")to which the City is entitled to appoint five members. <br /> 3. The officials and employees name below in Part 1 of this resolution are the City's <br /> initial appointments to the Authority Board since the name change. All of the initial directors <br /> will take office on May 1, 2018. All of the initial directors of the Authority Board will draw lots <br /> to determine which directors serve a one-year term expiring April 30, 2019, which directors <br /> serve a two-year term expiring April 30, 2020, and which directors serve a three-year term <br /> expiring April 30, 2021. Directors thereafter will serve staggered three-year terms. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> Part 1.
