135 <br />Regular Meeting July 26, 1999 Page 2 <br />"C" (COMMERCIAL DISTRICT); INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Moore closed the public hearing. Mr. Cox moved for <br />adoption of the Zoning Ordinance and Mr. Mihalkanin seconded the motion, <br />which passed unanimously. <br />Mayor Moore introduced for consideration a public hearing and adoption of <br />a Zoning Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 7.5 ACRE <br />TRACT OF PROPERTY LOCATED IN THE 1100 BLOCK OF SAN MARCOS PARKWAY, <br />FROM "C" (COMMERCIAL DISTRICT) TO "MF-4" (MULTI-FAMILY DISTRICT [HIGH <br />DENSITY]); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Moore closed the public hearing. Mr. Cox moved for <br />adoption of the Zoning Ordinance and Mr. Doiron seconded the motion. Mr. <br />Gilley advised the Council Staff recommends the City accept the street and <br />maintain it. There is some base failure on a portion of the roadway that <br />can be nominally repaired. The Council directed the developer contribute <br />to the street repairs if they are interested in improving same. The <br />Council voted unanimously for adoption of the Zoning Ordinance. <br />Mayor Moore introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 50.053 OF THE CITY CODE TO REPLACE THE APPEAL <br />PROCESS FOR THE DENIAL OF MOBILE HOME PARK PERMITS WITH A VARIANCE <br />PROCEDURE; PROVIDING FOR PENALTIES; INCLUDING PROCEDURAL PROVISIONS; <br />AND DECLARING AN EMERGENCY. <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency and Ms. <br />Hughson seconded the motion. Ms. Hughson moved to amend the Ordinance in <br />the first sentence of Section 50.054(a) to read, "The planning and zoning <br />commission may authorize a variance from the standards for mobile home <br />parks in this article. . . .," and Mr. Mihalkanin seconded the motion, <br />which passed unanimously. The Council then voted unanimously for adoption <br />of the Ordinance on emergency. <br />Mayor Moore introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 58 - PUBLIC FACILITIES, PARKS AND RECREATION, OF THE <br />CITY CODE BY AUTHORIZING ACCESS TO THE SPRING LAKE DAM CURFEW AREA TO <br />PERSONS INVOLVED IN THE DESIGN AND CONSTRUCTION OF REPAIRS TO THE <br />DAM; INCLUDING PROCEDURAL PROVISIONS; PROVIDING FOR PENALTIES AND <br />DECLARING AN EMERGENCY. <br />Ms. Hughson moved for adoption of the Ordinance on emergency and Mr. Cox <br />seconded the motion. Mr. Nance of SWT advised the Council TNRCC engineers <br />have looked at the deck at Joe's Crab Shack and said it was safe, as it <br />has a separate support structure. In response to the Council's concern <br />regarding the safety of SWT groundskeepers, Mr. Nance advised he had <br />spoken with Mr. Taylor and the area will not be mowed again. The Council <br />then voted unanimously for adoption of the Ordinance on emergency. <br />Mayor Moore introduced for consideration approval of an Ordinance on first <br />reading, the caption which was read as follows:
