FOR THE PURCHASE OF A <br />HYDRAULIC DIGGER FOR THE ELECTRIC UTILITY DEPARTMENT; AUTHORIZING THE <br />PURCHASING MANAGER TO EXECUTE CONTRACT DOCUMENTS ON BEHALF OF THE <br />CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE PARTIAL TERMINATION OF AN AGRICULTURE LEASE AT THE SAN <br />MARCOS AIRPORT BETWEEN CURBY OHNHEISER AND THE CITY; AUTHORIZING THE <br />CITY MANAGER TO EXECUTE THE LETTER OF PARTIAL TERMINATION OF LEASE; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Moore introduced for consideration Item 11.B. (1) removed from the <br />consent agenda, approval of an Ordinance on second reading, the caption <br />which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 102.029 OF THE CITY CODE BY ADOPTING THE SECTOR FOUR <br />PLAN; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Ms. Hughson moved for approval of the Ordinance on second reading, and Mr. <br />Cox seconded the motion. Mr. Patterson advised the Council the areas of <br />discrepancy between land use and zoning were addressed by the trends the <br />City is going to and will provide a list before the final reading. Zoning <br />designations cannot be changed without a formal notification process. The <br />Council voted unanimously for approval of the Ordinance on second reading. <br /> <br />Mayor Moore introduced for consideration Item 11.D. (1) removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE LEASE OF A TRACT OF REAL PROPERTY AT THE SAN MARCOS <br />MUNICIPAL AIRPORT TO DON SIMONS D/B/A SIMONS BUILDING CORPORATION; <br />AUTHORIZING THE CITY MANAGER TO SIGN THE LEASE; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Ms. Hughson moved for adoption of the Resolution and Mr. Cox seconded the <br />motion, which passed unanimously (Mr. Moseley not present to vote on this <br />item). Ms. Hughson requested a copy of the Airport Commission's'minutes <br />on items dealing with the Airport. She stated she would like to receive <br />copies of all Airport Commission minutes. <br /> <br />Mayor Moore introduced for consideration Item 11.D. (5) removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF A MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE CITY AND SOUTHWEST TEXAS STATE UNIVERSITY FOR THE <br />COORDINATION OF POLICE SERVICES; AUTHORIZING THE ENFORCEMENT OF CITY <br />ORDINANCES REGARDING ANIMALS, PUBLIC FACILITIES, PARKS, TRAFFIC AND <br />VEHICLES BY UNIVERSITY PEACE OFFICERS; AUTHORIZING THE MAYOR, CHIEF <br />OF POLICE AND CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE <br />CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Cox moved for adoption of the Resolution and Mr. Hernandez seconded <br />the motion. Mr. Doiron stated he agreed with Ms. Tschurr (citizen comment <br />period) and is hesitant to increase police powers of the University <br />expanding their authority over citizens of San Marcos. Ms. Hughson moved <br />to amend Section 2 of the Memorandum of Understanding to read, ". . . <br />until either party terminates the agreement by giving the other party one <br />day's written notice," and Mr. Doiron seconded the motion. On roll call <br />of the amendment the following vote was recorded: <br /> <br />AYE: Mihalkanin, Hughson, Doiron. <br />
