Regular Meeting October 11, 1999 Page 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN AIRPORT PROJECT PARTICIPATION AGREEMENT BEtWEEN THE CITY AND THE TEXAS DEPARTMENT OF TRANSPORTATION FOR GRANT FUNDING FOR AN AIRPORT MASTER PLAN FOR THE SAN MARCOS MUNICIPAL AIRPORT; AUTHORIZING TXDOT TO ACT AS THE CITY'S AGENT IN IMPLEMENTING THE AIRPORT IMPROVEMENTS SPECIFIED UNDER THE GRANT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT AND RELATED DOCUMENTS ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AMENDMENT NUMBER THREE TO THE LEASE OF CITY PROPERTY TO THE SAN MARCOS AREA CHAMBER OF COMMERCE; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT; AND DECLARING AN EFFECTIVE DATE. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN AGREEMENT BETWEEN THE CITY AND CARTER & BURGESS, INC. FOR PROFESSIONAL SERVICES IN CONNECTION WITH THE WATER LINE ENCASEMENTS PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. Mayor Moore introduced Item 9.B. (5) removed from the consent agenda, adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AMENDMENT NO.1 TO THE AGREEMENT WITH BROWNING-FERRIS, INC. TO INCREASE RATES FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID WASTE AND RECYCLABLE MATERIALS; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT; AND DECLARING AN EFFECTIVE DATE. Mr. Moseley moved for adoption of the Resolution and Mr. Cox seconded the motion. Mr. Hernandez has received lots of phone calls regarding missing collection days on a regular basis. Neighborhoods have gone uncollected. Richard Medina stated BFI has added an additional truck and said the scheduled times for collection may have changed, but BFI is giving better service. Mr. Medina stated he has received only one complaint from the neighborhood Mr. Hernandez is referring to and that the City received one to two complaints per week regarding BFI service. Anyone with collection problems can call the City or BFI directly. Linda Rife of BFI stated they had worked closely with the downtown area to clean up downtown. She provided the Council with a copy of a letter signed by the Downtown Association President, Rob Robinson, thanking BFI for successfully addressing their concerns. Ms. Rife also reviewed with Council a handout of a BFI monthly report regarding recycling participation, recycling volumes and customer service calls. On roll call for adoption of the Resolution the following vote was recorded: AYE: Mihalkanin, Hughson, Doiron, Moore, Moseley, Cox. NAY: Hernandez. ABSTAIN: None. Mayor Moore introduced for consideration removing from the table and adoption of an Ordinance on emergency, the caption which reads as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, INCREASING THE RATE FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID WASTE AND RECYCLABLE MATERIALS; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. Mr. Doiron moved to remove the Ordinance from the table and Mr. Cox seconded the motion, which passed unanimously. Mr. Moseley then moved for adoption of the Ordinance on emergency and Mr. Cox seconded the motion. On roll call for adoption of the Ordinance on emergency, the following vote was recorded:
