<br />Regular Meeting September 13, 1999 Page 58. <br /> <br /> <br />INCREASING THE AMOUNTS OF VARIOUS DEVELOPMENT-RELATED FEES; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Ms. Hughson moved for approval of the Ordinance on second reading and Mr. <br />Hernandez seconded the motion. Ms. Hughson moved to amend Section 4, <br />Subdivision Master Plan, to charge $250 flat fee, in Section 5 under <br />Specific Use Permits, alcoholic beverage sales to charge a fee of $1,000 <br />for mixed beverage permits and a fee of $500 for beer and wine permits, <br />and also under Specific Use Permits, telecommunications towers, a fee of <br />$1,000 for a new tower and $250 to locate on an existing tower, and Mr. <br />Moseley seconded the motion, which passed unanimously. Ms. Hughson asked <br />if it was permissible to charge a different fee in the ETJ, and was <br />advised it is permissible if the amount is consistent in the ETJ. She <br />said she was thinking of 25% more, and Mr. Gilley stated that would be <br />reasonable. Mr. Mihalkanin moved to amend the Ordinance to accept the <br />subdivision fees and zoning fee and development related fees of the <br />Planning and Zoning Commission. The motion failed for lack of a second. <br />Ms. Hughson stated the Council needs to look at these fees again in one <br />year to see what we are recovering. Ms. Hughson moved to amend Section 4 <br />for the amounts to be 125% more for the ETJ and Mr. Doiron seconded the <br />motion, which passed unanimously. Mr. Mihalkanin asked for the reasoning <br />for the Planning and Zoning Commission's recommendations, and Mr. <br />Patterson stated the Staff's recommendations were collected from other <br />cities and the Planning and Zoning Commission wanted full cost recovery <br />except for small scale projects (under 5 acres). Mr. Mihalkanin stated <br />this could be a real issue if the goal is not to hurt property owners but <br />recover costs; there should be a system to recover the same amount from <br />each. Mr. Patterson stated Staff recommended a sliding scale (recommended <br />in the David Griffith study) as more time is spent on larger projects. <br />Mr. Mihalkanin stated he thinks San Marcos is subsidizing large projects. <br />Mr. Hernandez stated we have little aff~rdable housing now, and if we have <br />a large fee, he is afraid this housing will be driven away. On roll call <br />for approval of the Ordinance on second reading, the following vote was <br />recorded: <br /> <br />AYE: Hughson, Doiron, Moore, Moseley, Hernandez. <br /> <br />NAY: Mihalkanin. <br />ABSTAIN: None. <br /> <br />Mayor Pro-Tem Mihalkanin introduced for consideration Item S.D. (4) removed <br />from the consent agenda, adoption of a Resolution, the caption which was <br />read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF AN AMENDED LETTER OF AGREEMENT <br />BETWEEN THE CITY AND PADGETT, STRATEMANN & CO., L.L.P., TO EXTEND THE <br />ANNUAL CONTRACT FOR THE PROVISION OF AUDITING SERVICES; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Hernandez moved for adoption of the Resolution and Mr. Doiron seconded <br />the motion. Mr. Gilley advised the auditors made a $4,000 error. They <br />did not allocate funds for Y2K testing. The Council voted unanimously for <br />adoption of the Resolution (Mayor Moore not present to vote on this item). <br /> <br />Mayor Pro-Tem Mihalkanin introduced for consideration Item S.D. (6) removed <br />from the consent agenda, adoption of a Resolution, the caption which was <br />read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE EMERGENCY PROCUREMENT OF DOMES FOR ODOR CONTROL AT THE <br />WASTEWATER TREATMENT PLANT AND LABOR IN CONNECTION WITH THE <br />INSTALLATION OF THE DOMES; RATIFYING THE ISSUANCE OF A PURCHASE ORDER <br />FOR THE DOMES; AND DECLARING AN EFFECTIVE DATE. <br />
