Mr. Hernandez stated the Sector 2 Plan <br />approved some multi development, and if the apartments do not. go in this <br />project, they will go in somewhere in Sector 2. The Council recognized <br />apartment development has already occurred in Sector 2. On roll call of <br />Mr. Hernandez' motion, the following vote was recorded: <br /> <br />AYE: Mihalkanin, Moore, Hernandez. <br /> <br />NAY: Hughson, Moseley, Cox. <br /> <br />ABSTAIN: None. <br /> <br />The motion failed. Mr. Mihalkanin then moved to approve the Zoning <br />Ordinance and Mr. Hernandez seconded the motion. On roll call the <br />following vote was recorded: <br /> <br />AYE: Moore, Hernandez. <br /> <br />NAY: Mihalkanin, Hughson, Moseley, Cox. <br /> <br />The motion failed. <br /> <br />Mayor Moore introduced for consideration approval of an Ordinance on first <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTIONS 2.151, 2.152, AND 2.153 OF THE CITY CODE TO REMOVE <br />YOUTH FROM THE PURVIEW OF THE HUMAN DEVELOPMENT COMMISSION; ADDING A <br />NEW DIVISION 17 TO CHAPTER 2, ARTICLE 3 OF THE CITY CODE TO ESTABLISH <br />A SAN MARCOS YOUTH COMMISSION; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Mr. Mihalkanin moved for approval of the Ordinance on first reading and <br />Ms. Hughson seconded the motion. Ms. Hughson moved to amend the Ordinance <br />in Section 2.362(a) for the commission to be composed of 15 members with <br />each Chamber of Commerce having a representative, in Section 2.362(b) <br />adding, ~Youth members must be at least 14 years of age," and Section <br />2.363(b) to read, ~The commission acts in an advisory capacity to the city <br />council, the Parks and Recreation Board, other boards and commissions and <br />the city manager on matters involving youth in the San Marcos community. <br />For purposes of this division, the term ~youth" means a person 18 years or <br />younger in age. The commission will endeavor to involve the entire <br />community in promoting fundamental resources, or goals, for the healthy <br />development of all youth in the greater San Marcos area, including but not <br />limited to the following: .. .," and Mr. Mihalkanin seconded the <br />motion, which passed unanimously. The Council then voted unanimously for <br />approval of the Ordinance on first reading. <br /> <br />Mayor Moore introduced for consideration approval of an Ordinance on first <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ADDING NEW SECTION 1.018 OF THE CITY CODE TO SPECIFY CULPABLE MENTAL <br />STATES FOR VIOLATIONS OF THE CITY CODE; ADDING A NEW SECTION 82.008 <br />TO THE CITY CODE TO DISPENSE WITH THE NEED FOR A CULPABLE MENTAL <br />STATE FOR VIOLATIONS OF CHAPTER 82, TRAFFIC AND VEHICLES, OF THE CITY <br />CODE; INCLUDING PROCEDURAL PROVISONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mr. Mihalkanin moved for approval of the Ordinance on first reading and <br />Mr. Hernandez seconded the motion, which passed unanimously. <br /> <br />Mayor Moore introduced for consideration approval of an Ordinance on first <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ADDING A NEW DIVISION 3, NOISE, TO ARTICLE 3, NUISANCES, OF CHAPTER <br />
