ORDINANCE NO. 2009- 42 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM "C" COMMERCIAL TO "MDR" <br />MEDIUM DENSITY RESIDENTIAL FOR A 0.84 ACRE, MORE OR <br />LESS, TRACT OF LAND LOCATED AT 1011 UHLAND ROAD; <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING THIS TRACT FROM "CC" COMMUNITY <br />COMMERCIAL DISTRICT TO "MH" MANUFACTURED HOME <br />DISTRICT; AND INCLUDING PROCEDURAL PROVISIONS <br />RECITALS: <br />1. On June 23, 2009, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "C" Commercial to "MDR" Medium Density Residential, and a <br />concurrent request to change the zoning from "CC" Community Commercial District to "MH" <br />Manufactured Home District, for a 0.84 acre, more or less, tract of land located 1011 Uhland <br />Road. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />• considered and voted to approve the requests on June 23, 2009, and recommended that the <br />requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on August 4, 2009 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from "C" <br />Commercial to "MDR" Medium Density Residential: <br />Street address: 1011 Uhland Road <br />Size: 0.84 acres, more or less <br />0
