• ORDINANCE NO. 2009- 43 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM "LDR" LOW DENSITY <br />RESIDENTIAL TO "MDR" MEDIUM DENSITY RESIDENTIAL FOR <br />A 0.1890 ACRE, MORE OR LESS, TRACT OF LAND LOCATED AT <br />510 HARVEY STREET; AMENDING THE OFFICIAL ZONING MAP <br />OF THE CITY BY REZONING THIS TRACT FROM "SF-4.5" SINGLE <br />FAMILYDISTRICT TO "DR" DUPLEX RESTRICTED DISTRICT; <br />AND INCLUDING PROCEDURAL PROVISIONS <br />RECITALS: <br />1. On June 23, 2009, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "LDR" Low Density Residential to "MDR" Medium Density <br />Residential, and a concurrent request to change the zoning from "SF-4.5" Single Family District <br />to "DR" Duplex Restricted District, for a 0.1890 acre, more or less, tract of land located 510 <br />Harvey Street. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />• considered and voted to approve the requests on June 23, 2009, and recommended that the <br />requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on August 4, 2009 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from "LDR" <br />Low Density Residential to "MDR" Medium Density Residential: <br />Street address: 510 Harvey Street <br />Size: 0.1890 acres, more or less <br />0
