0 ORDINANCE NO. 2009- 45 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING 0.3339 ACRES, MORE OR LESS, OUT OF THE ORIGINAL TOWN OF SAN MARCOS, LOCATED AT 119 SOUTH EDWARD GARY STREET, FROM "CC" COMMUNITY COMMERCIAL DISTRICT TO "CBA" CENTRAL BUSINESS AREA DISTRICT; AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. On June 23, 2009, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "CC" Community Commercial District to "CBA" Central Business Area District, for 03339 acres, more or less out of the Original Town of San Marcos, located at 119 South Edward Gary Street. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission considered and voted to approve the requests on June 23, 2009, and recommended that the requests be approved by the City Council of the City. 3. The City Council held a public hearing on August 4, 2009, regarding the requests. • er 1 Development Procedures of the City Land 4. All requirements of Chapter ty Development Code pertaining to Future Land Use Map Amendments and Zoning Map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the City Land Development Code, is amended to rezone the following real property which is presently zoned "CC" Community Commercial District to "CBA" Central Business Area District: Street address: 119 South Edward Gary Street Size: 0.3339 acres more or less. Legal description: East %2 of Lots 3 and 4, Block 9, Original Town of San Marcos. ?J
