<br /> <br />and expenses of its legal counsel) related to the Major Improvement PID Bonds, and (ix) <br />administering the construction of the Public Improvements. <br />“Administrator” means an employee of the City or third party designee of the City who shall <br />have the responsibilities provided for herein, in an Indenture relating to Major Improvement <br />PID Bonds or in any other agreement approved by the City Council. <br />“Annual Installment” means, with respect to each Parcel, each annual payment of: (i) the <br />Special Assessment (including the principal of and interest on), as shown on the Assessment <br />Roll attached hereto as Appendix A, as applicable, and calculated as provided in Section VI <br />of this 2018 SAP, (ii) Administrative Expenses, (iii) the Additional Interest. <br /> <br />“Annual Service Plan Update” means any update to this 2018 SAP. <br /> <br />“Assessed Property” or “Assessed Properties” means property on which Special <br />Assessments have been levied as shown on the Assessment Roll (as the same may be updated <br />each year by an Annual Service Plan Update) and which includes any and all Parcels within <br />the PID other than Non-Benefited Property. <br /> <br />“Assessment Ordinance” means each ordinance adopted by the City Council approving this <br />2018 SAP (or amendments or supplements to the 2018 SAP) and levying the Special <br />Assessments. <br /> <br />“Assessment Roll” means the Assessment Roll included in this 2018 SAP as Appendix A, <br />which may be updated, modified or amended from time to time in accordance with the <br />procedures set forth herein and in the PID Act, including updates prepared in connection <br />with the issuance of Major Improvement PID Bonds or in connection with any Annual Service <br />Plan Update. <br /> <br />“City” means the City of San Marcos, Texas. <br /> <br />“City Council” means the City Council of City of San Marcos, Texas. <br /> <br />“County” means Hays County, Texas. <br /> <br />“Creation Date” means the date, October 20, 2015, the City Council approved Resolution No. <br />2015-145R which authorized the creation of the PID. <br /> <br />“Delinquent Collection Costs” means interest, penalties and expenses incurred or imposed <br />with respect to any delinquent Special Assessment, or an Annual Installment thereof, in <br />accordance with the PID Act which includes the costs related to pursuing collection of such <br />delinquent Special Assessment, or an Annual Installment thereof, and the costs related to <br />foreclosing the lien against the Assessed Property, including attorney’s fees. <br /> <br />“Fire Station Agreement” means that certain agreement entered into between the City and <br />the Landowner on November 2, 2015. <br />4 <br /> <br /> <br />
